Hi,

I was recently arrested and charged for underage possession of alcohol and drunk in public. My lawyer plans to ask the judge to take the case under advisement, which to my understanding comes with community services, maybe a course, and a list of other things. I live in the state of Virginia, and if you are convicted of a crime of this manner, the judge is required to suspend your license. Is taking a case under advisement the same as a conviction?

No, in this case it would seem that your attorney is (wisely)pursuing a deferred disposition under Va. Code Sec. 4.1-305F which, if you successfully

perform all the conditions required, will allow you to emerge from this

unhappy event without a record of conviction.
