If I ordered a dress from a company and the company does inform me in a timely manner that my dress won't be back in time and doesn't want to give me my money back can I sue?

This is not a legal ethics question, and since you chose to not tell us the terms of the agreement you had with the company concerning delivery date, refund policy, etc. you can't get an answer. How are we (or the company) to know what you mean by "back in time?"
