My doorman accepted court documents from a process server at my residence. Am I obligated to sign for and pick up the documents, or are they already considered served?



Answer

In a gated community, the gate guard, and in your case, I believe, a doorman is sufficient substituted service. There is very little advantage to avoiding service no matter what, since if you can't be personally served, and no other substitute for personal service is availing, a party may serve by publication. And, if you get served by publication, you may not see the ad, may not retain counsel and may have a default judgment entered against you. My advice is to accept the service and do what you must.
