I married a man four years again and just found out he was not legally divorced. What dose this mean for me? Do i have to file for divorce? And what about taxes?



Answer

A bigamous marriage is that which is entered into by someone who is already married. The Law in North Carolina states that a person may only be married to one person at a time any subsequent marriage is not recognized and is automatically invalid in North Carolina. Your marriage is therefore void and void from its inception. You do not need a divorce or an annulment as that marriage is not recognized under the laws of the state of North Carolina but it is best to get a court order acknowledging the marriage as void for any issues that may arise in the future.



Answer

It means that legally you are no married. He needs to get a divorce and then you need to re-marry him if you wish to still be married to him. Your marriage is void as if it never happened.
