In the state of Virginia does abandonement effect a persons rights? Someone has to leave the home, I am confused on what consituites abandonment. I am considering moving out but not sure if it will end in divorce.
Answer
A spouse who moves from the marital home but remains accessible to and
in contact as appropriate with family members and/or spouse who remain
behind is unlikely to be charged with a sustainable charge of
abandonment under current Virginia law (in my opinion).
