Question

I live in Virginia and my boyfriend was just turned down by a government job due to a back surgery well over 6 months ago. He has no restrictions due to the surgery whatsoever. Is this legal for employers to do?

Answer

Yes, as long as it didn't involve reasons connected with race,

religion, gender, etc, or other such specially protected categories

under federal law where claims of unlawful discrimination are normally

subject to heightened scrutiny.
