We just had a child that lived for 16hours. Right after birth my wife called our insurance provider and added him to our plan. We had also spoke to several associates of our insurance plan before this event to be sure our son would be covered. Unfortunately he died after 16 hours.

We received a call today from our insurance company stating in order for our son to be covered he had to live for 14 days. None of this was ever explained to us. We spoke to several individuals from our insurance company and not once did anyone explain this to us.

What rights do we have? How do we fight this?

If there is no provision, then the renters still owe rent, even if they choose to live elsewhere. The one who left for medical reaosns , may have claim that they coudl nto go on with the lease, due to health, and may get excused by the court. The one who chose to study elsewhere, appears to still owe rnet (an perhaps the full rent for noth tenants) Has either of ht renters looked into subleasing the sopace. Perhaps ther are trenaferring student who only need a place for five months. You might consider consulting directly wiht a civil atotrney in your area who can read your lease and give you advice specific to yrou situation.

My son Sgt. Kyle Hirvela USMC is deployed and has some issues with his old Bronco title. He spent many summers putting together and old bronco from a pile of parts. He registered it with DMV and that was it or so he thought. The Body that was originally on his frame was left at a body shop by the guy that bought it. The body shop filed a lien on it and acquired the pink slip when my son did not contest it because he was deployed. According to the CHP the frame is what they go by and has precedence over the body, but the state lien office says it too late. We are not sure what to do.

Do what? Restore clean title to the frame in your possession, with body?

It sounds like the lien sale was done on the basis of the VIN on the dash of the body, which creates a conflict with the separate frame which also has the same VIN. You created two vehicles with the same VIN. You'll have to deal with and appeal through DMV to try to straighten this out and get titled 'cleaned' and registration issued correctly. If you want to hire an attorney to do it, or help you do it, feel free to contact me to discuss the fees you'll have to pay. You can go stand in line yourself at DMV and start telling your story and showing all your documents and evidence, and work your way through the system as best you can. This could take weeks or months. You can't contest the lien sale, it is too late. You have to try to clear title. to your version of the VIN vehicle.

I was doing what I could to help her from getting deported. The last that we actually lived together was 2 years ago. She was deported back to Poland via voluntary departure September of 2011. We need to proceed with a divorce. I am trying to see if this is something that I can pursue on my own or will I need a lawyer to represent me? In May of 2012, she filed for custody to be reversed. We went to court in SC, and I retained primary custody. In addition, I was awarded child support which was not previously being paid. The order came down in October of 2013 but was not stamped and filed until January of 2014. I asked the mother when to expect a payment because the order called for support to begin in November of 2013 and she said none was coming. She said she is filing another motion with the court in SC. Does she owe the money from the previous order regardless of what motion she files next, and can I pursue the money through the VA court system or do I need to go back through the SC system?

You need to actually have a legal expert review your title for the car. Impossible to answer your question on the facts as presented. If you are an actual owner on the title you cannot be ousted by her, but the creditor can collect the vehicle if payments are not timely made.

If you want to "divorce" your co-owner you may have to file a partition action (filing fees are over the top). Then the judge sells the car at public auction and splits the net proceeds.

Also, as a co-owner your partner has to pay you one half of all car expenses you have incurred, and which should have been shared.

Watch out to insure that monthly premiums are up to date or the company that holds the 'mortgage' (security interest and financing statement) will send out the repo guys. Not good.

There is also a practical solution, very much subject to explanation and approval by the attorney you hire. You take the car and give it to your attorney or other fiduciary to hold (possibly you will need to switch out keys). Giving it to a third party fiduciary to hold pending resolution of your matter may do the trick. I am not counseling anything that could be construed as criminal on your part. That is why I want an attorney to approve this idea after meeting with you face to face. Do not to go on the property of the co-owner or you could be charged with trespass.

1. Send a new e-mail detailing your attempts to contact the manager of the plot and her promise to send to you the contract. Ask how much those p[lots would now sell for and at the time of your mother's death [my condolences]. Have your siblings made an effort to sell the plots, how would one go about doing so, how is the market for re-purchase. Point out and ask her if she denies that you have partial title to the plots and that they can not be sold without your consent, how are the plots held[ tenants in common, joint tenancy, your mother have any legal ownership?]. State that at this point, until you notify her in a written letter to the contrary, you refuse to sell either of the plots and demand that she notify you immediately of any attempt made by your siblings to sell it. Demand that she send to you a copy of the contract and any other paperwork concerning the plots, and that she confirm in writing that she understands your approval is needed to sell the plots or any portion of them. Point out that you know she is busy but her not returning message is not acceptable and that if she does not fully respond within 5 business days you will have no choose but to go to her superior [ask for contact information] or the board that oversees the business. That if the property is sold they will be liable to you for damages.

One wk later we were told to get out if we cant pay the entire balance off. So we moved. We were asked to sign an agreement to pay off the remaining balance. We are now getting emails that if we dont pay this entire balance off then we will be prosecuted for theft of sevices? I suppose "technically" it could be criminal, but even most officers would view this as a civil matter because you had no intent to defraud the manager you simply couldn't afford to pay. If it's about money it is usually, but not always, a civil matter.

The range of punishment for theft type offenses is based upon the amount taken. If the amount stolen is greater than $100,000, the offense is a first degree felony which carries a range of punishment of 5 to 99 years in prison with a optional fine of up to $10,000. The court would require restitution of the funds stolen, even if the funds were subsequently stolen from the thief.

Texas has bifurcated criminal trials. After a defendant is found guilty, there is a separate trial on punishment. The defendant, can elect to have the judge sentence him or ask the jury to sentence him. As this would be the same jury that found him guilty and are not likely to have had any experience with sentencing while judges see will have had more exposure to sentencing, many lawyers will advise their clients to opt for sentencing by the judge.

Debt Collection (Missouri) -- in June 2012 I moved residences and neglected to inform the electric company of a forwarding address. Long story short I was frustrated to find a delinguency in the amount of $343 had shown up on a copy of a credit report that a landlord at a (third) new residence had ordered prior to my moving into a new apt in Mar 2013. I payed the electric company (the original creditor) in full on Apr 14, 2013 unaware that a collections agency was also involved in this matter. Fast forward to present day, I have recently obtained a hard copy of my credit score with a collections agency claiming a delinquency in the amount of $18 for the very same bill and showing non-payment of said amount as of Nov 2012. I never, not once, received any correspondence or communication from the collection agency in regard to the debt in question. I am confused as to how the collections agency can have a stake in this claim, or converesely, if the debt was sold to the collections agency, whether or not the electric company had a legal claim to the aforementioned debt and broke any laws by accepting payment from me. I am not sure whether to dispute the $18 or simply pay it and be done with the matter. I would also like to know where this $18 came from in the first place, are collections agencies legally allowed to charge interest or service fees on accounts receivable that they have purchased??

It is very common for landlords to lose Unlawful Detainer cases for reasons that have nothing to do with whether the tenant is guilty or not. The procedures that must be followed to get a UD case properly before the court are detailed, complex, and one slip allows the court to rule in favor of the tenant, even if the tenant is totally guilty of unlawful detainer. I guarantee you that the court did NOT rule in favor of the tenant on the grounds that the tenant doesn't owe rent just because the landlord is not paying his mortgage, and if the court was stupid enough to rule that way, and the landlord appeals, the ruling would be thrown out. It is none of the tenants' business what the landlord does with the rent money as long as the landlord does not breach the lease or let the property fall apart so bad it is legally uninhabitable. As long as the landlord is the legal owner of the property, the tenants owe him rent as agreed. The bank actually has the right to claim the rent money if the landlord is not paying, but as long as they are doing that they can't foreclose. Banks don't want to be landlords, so they let the landlord keep the money and then they foreclose. That is all between the landlord and his bank, none of the tenants' business. You have no right to stop paying rent just because the landlord isn't paying his lender. So if you don't pay your rent, and the landlord figures out what he did wrong with the UD proceedure, you will find yourself out on the street.

This is way too complicated and incomplete at the same time. Children can be subpoenaed to testify in court hearings. The fact that they are young just means they are supposed to be treated appropriate for their age. But they are ALSO entitled to have their own attorney (at your cost I'm afraid unless there are special circumstances). As to when they have to appear, again this is something that is usually worked out dependent on everyone's schedules but sometimes court hearings require specific attendance. You can try this on your own but it sounds like you could use an attorney's help to make your way through the system.

You will not lose your license provided you either go to court and get a reduced plea or hire an attorney. In fact, you may not even get insurance points depending on the plea. Usually when they send you a cease and desist letter all there asking is for you to stop; if you comply it usually ends there. It is a rare occasion that when you comply a lawsuit is followed up with a cease and desist letter.

If you are your daughter's only heir (no husband, kids or other parent) you can collect her assets without probate (small estate affidavits.) However, if her liabilities (debts) are greater than the assets, it might not be worth collecting them, since they will be subject to claims by creditors. If any of her assets had pod/beneficiaries listed (such as an IRA) they can be claimed by the named beneficiary without that person being liable for any debts. If you are not her heir, you are not responsible for debts or administration of the estate (unless you filed a petition for probate asking to be appointed administrator of the estate) and could not claim any reimbursement for "expenses."

Child support ends at age 21 unless there is a prior emancipation. Children have no right to control parenting time and the custodial parent can be held in contempt. A court may require counseling since there may be emotional issues for the children that need to be dealt with as it is not normal for children to not want to see a parent. Unless your decree states otherwise, the Parenting Time Guidelines states that a non-custodial parent gets his or her choice of time, if notice is provided by April 1, if not, thecustodial parent gets to choose. You also are entitled to makeup time.

It sounds like you need to lawyerup as you have some time deadlines here and may not be able to get into court before the summer if you do not act now.

My mother died without a will. Her and my father had been married 60 years and acquired a house during that time. The property was held in joint tenancy for 46 years. In 2003, my father executed an inter-spousal property transfer to my mother for certain business reasons. The intent was to have this changed back to joint title/ community property but that never happened prior to my mother's death. They had trusts completely drawn with instructions for a quit claim 2 weeks prior to my mother's death. She became ill and they were not signed. My father is still on the note. I would like to help him file a Spousal Property Petition but need to know how to list their home. My mom held title but it was always understood between them that it was community property. She had no other separate assets. If anyone can help, I'd appreciate it. P.S this is form DE-221 in CA.

She and the alleged father had shown no interest or financial support. On July 13, 2011 in Huntsville alabama, The sheriff came to my home with an order that said I was to return my child to allege father. This man has never done anything for this child. Nor do I believe he is the father. I'm astounded that the state of Tennessee, Rutherford County would allow this to happen. I have also found out that he has been filing my child as a dependent on Federal tax form, earned income credit. This is ridiculous.

If you legally adopted the child, then the father's (or alleged father's) parental rights would have been terminated in the process. An adoption makes you the child's legal parent. My guess is that when he filed his petition with the court in Tennessee, he did not tell them that you had legally adopted the child in Alabama. You need to retain an attorney in the county where the court order was issued, and have that attorney file a motion to quash the order and a motion to dismiss the petition he filed on the basis that he no longer has any legal rights to the child. That attorney will need a copy of the adoption paperwork from your Alabama adoption file.

Good luck to you. Call the attorney who handled the adoption and see if he or she can refer you to an attorney in Tennessee to set aside this court order.

Now I'm signing up for classes. The Core program and they ask if I was ever in treatment before. I don't want to tell them but they are asking.. they also require a ss#. My question is does Florida's core system communicate with njs IDRC program. Should I tell Florida of the previous offense?

While criminally you may have only received a "first" offense, the DMV will consider this a second offense. You should probably have to sign up for the Level II school because of the NJ prior. The DMVs of both states do communicate so if the DMV says you need Level II that's what you have to take despite what the criminal court may have done.

I used to work in USA on H1-b visa in past during year 2006 to 2010. I am out of USA for last 30 months now. My previous employer would like to take me back on payroll. My questions at this time:

1) Do I need to file my H1-B in new quota (April 2013) or I am eligible to file extension as I did not used 6 years on my last visa and I am out of USA for more than 1 year now.
