The Navy, or any branch of the armed forced won't take anyone on probation. You should try to get a diversion program fronm the judge, so that your son doesn't lose his drivers licence for 1 year, as well as the diversion program is relatively short. If your son pleads, he WILL lose his license, the conviction will be on his record, but there is no probation, if the charge is an infraction. I would try for diversion. I wish you well...... However, I sense that your concern is that the tenant's may actually pay the bill as required and you will have then made a second payment and may not get the money back. If so, hold so much of the security deposit in escrow as is necessary to pay the final bill. Note that on your accounting for the security deposit and invite the tenants to send you proof of payment in order to get the money released.

However, I suggest you send a letter to the tenant (Certified Mail, Return Receipt Requested) stating that there is an open bill and the amount, and if not paid by its due date, with verification to you, it will be paid from the security funds. If not paid, or verified by the date specified, pay it.

If she is fat she is fat. That is simply her physical condition. And in this case the reason why she was not allowed on the slide. From what you posted, it appears that the lifeguard first simply said your daughter was "too big" and you apparently mistook "big" to mean age, not weight. The lifeguard apparently had to be more explicit with you about what "big" meant -- apparently weight. So it appears that in fact the lifeguard was attempting to be less hurtful and your clarification is what brought out a more "explicit" meaning. I'm not sure if "fat" or "overweight" is more or less "hurtful". Otherwise, weight (obesity or otherwise) is not per se considered a disability for purposes of most discrimination laws including the ADA.

There are companies that loan money using inheritance as collateral. They are much like loans against personal injury settlements. They charge fees and interest and will investigate of course. Failing this, if this estate is in Probate Court and more than six months have passed you can petition the court to require the Executor or Trustee to give an update and explanation of delay. I am sorry to hear about the loss of your wife's uncle.

It is possible for an heir to renounce the inheritance. In that case, however, the laws of intestacy apply to determine who is next in line to inherit. Your wife and her sister could not "apply" for the estate in lieu of the two brothers.

A good probate lawyer will help you figure this out. You should be able to find someone here on LawGuru, if your wife has not already retained counsel. Many of us are skilled in contentious probate proceedings.

If each brother of the decedent signs a "decline to serve", you wife can apply to be appointed the administrator of the estate. Her uncles would still be the beneficiaries, but she would be entitled to collect a tidy fee for her trouble at the end of the probate process. Sorry to hear about the family squabble. It is common unfortunately. Anybody can service as administrator of the estate so this would be no problem. Pursuant to California Probate Code 8461 there is an order of priority for who is to serve. However, anybody can serve. The declinations to act, or nominations of your wife, would be great but are not required for your wife to serve as the administrator. As the other attorneys have addressed the issue of who serves as administrator and who receives the inheritance are totally separate issues. I do these kind of cases all the time throughout California including San Francisco. In fact, I have probably done at least 800 probate cases during my 20 year career. If the employees are claiming unpaid overtime, the deadline for the employees to sue (statute of limitations) is 3 years or 4 years if they bring a claim called unfair business practices (usually when a company fails to pay many or all employees the wages owed). To avoid a lawsuit, which if you are found liable, may be held to pay waiting time penalties, interest and/or their attorneys' fees - you may want to do an audit of their pay - going back 3-4 years and pay them what is owed. Have them sign a contract agreeing that they have been paid in full. I strongly suggest that you call an employment law attorney to guide you through this and to draft the agreement. Wage lawsuits can get very expensive.

If the account uses your social security number, its income, profits and losses must be included in your return - single, married filed jointly or (although usually more expensive taxwise) married filing separate. One suggestion is to create a trust and keep these funds separately registered in the trust's name and using a taxpayer identification number specific to the trust. If properly drawn (and I have literally created hundreds for clients) not only will it keep the assets from becoming marital assets (equitable distribution assets in the event of divorce), it could provide tax benefits (both income and estate), estate planning benefits, asset protection from creditors, and more.There are some minor marital and divorce ramifications if income or the assets are used to pay family bills. In Pennsylvania the marital estate (assets & liability) are split under equitable distribution. The theory being that the estate is divided so that both parties have enough to move on in their lives. Sometimes the estate is divided 50-50. Sometimes 60-40. Sometimes different assets are split in different percentages. It really depends on the facts of a given case.

To my knowledge, when I left the company the card was at a zero balance. Now I live in the State of California and have been here since 2007. Citibank has now sued me and this case has been going on for 2 years and now the case will be on trial for the judge to decide in Nov. Can a credit card company sue me years later especially since I live in a different state and have not worked for the company in years. What can I do? I have contacted the credit card company and the company lawyers for years and even try to dispute this credit card and have been unsuccessful. The card limit was less than 2,500 and they want to sue me for 13,000 in late fees and lawyers fees; mostly late fees. Is this even legal to charge 10,000 in late fees? Is bankruptcy my best option? Can I sued the company for charging me years later, is this legal?

If the case is set for trial in November 2011 then you need to find a lawyer to represent you immediately. In fact, your lawyer might have to request a trial continuance. This sounds like a complicated case involving the laws of your former state to be applied in a California case. The fact that you moved to another state does not affect your liability for the debt. Also, the credit card company can sue you several years after you stop paying. It depends on the law of the state where you got the credit card. Since it sounds like the card was in your name, you might be liable. Whether or not you can be charged so much in fees for late payments, interest, etc. depends on the law of the state where you got the card. Also, you say the balance was zero when you left the company and stopped using the card. It sounds like you did not close the account. Nevertheless, you might be able to prove that tge charges were made without your consent. Bankruptcy might be an option, particularly if you have other debt. The cost of defending the lawsuit will probably be more than the cost of the bankruptcy attorney.

The fees they are asking for sound high. If it goes to trial, the plaintiff will have to prove it's case -- i.e., that you agreed to the charges or are otherwise liable. Most collection cases that go to trial end up with a judgment for plaintiff, but occasionally, the defendant can win. My approach would be to first, find out what evidence the plaintiff has that you are liable, second, attempt to negotiate a favorable settlement, and third, decide to either file a bankruptcy or defend the suit.

What you are asking is not necessarily something an attorney will just "give away". You may be able to find a form disclaimer on-line.

However, before you take this action, you should discuss this action with a CPA because the gift you are giving to your sister may have a tax consequence.

Also, in order to administer the trust correctly, you and your sister will need to send out certain notices to state agencies and pay any outstanding liens or bills incurred on your mother's behalf. Also, you will need to file an Affidavit Death of Trustee and transferring title of the house into you and your sister's names as Trustee's of the Trust. You, as trustee, will also have to file your mother's final tax return. Among other duties.

I strongly agree. A disclaimer only results in you being treated as having predeceased the decedent. If the trust indicates your share goes to your kids, or to a charity, if you die first, your disclaimer does NOT do what you want. A review of the governing documents is critical. Seek counsel. By the way, a disclaimer can generally be used only if implemented within 9 months of the date of death. This rule may also prevent it's use. There may be circumstances where your taking the property and gifting it to your sister is the right way to go. It does (or may) impact your own planning and how you do this may greatly impact property tax bills.

That is an affirmative defense to be pled in your answer if the defendant files a cross-complaint to enforce the provisions you contend are unenforceable. You could theoretically include a cause of action for declaratory relief as to the enforceablility of the provisions youu contend are not enforceable, but there really is no point in that unless their unenforceablility is somehow essential to your breach claim on the enforceable provisions.

She wrote and agreement and gave it to her company which was never executed - but was followed in daily business operations by the company. She was paid a commission of 20% of the gross revenue when received by the company and was non-refundable to the paying party. The paying party makes two payments to the company, 50% of a contract vale at signing and 50% upon the use of a facility as an event venue. My wife was receiving 20% of the 50% when collected on contract signing and the remaining 20% of the second 50% upon full payment for the event.

The company now wants to pay her only upon the final contract payment in full - not upon the receipt of non-refundable payments as they have been using for operations for the last year. The company is afraid that if the company has to cancel an event, the company will have to refund the payment Any decision to cancel an event will be the company's decision and not my wife's. Can she force the company to continue there procedure which has been in force for over a year? Also, the cash generated from the first 50% payment on all contracts is being used as operating capital for the company. The company is paying other operating expenses from the received non-refundable cash, such as utilities, landscaping, legal, bookkeeping, etc.

Unless the change in compensation would place her under minimum wage, or unless there is a contract that is agreed to remain in force for a specified period of time, the employee is "at will" and the employer can change the term and conditions of employment at any time, or simply fire the employee if they don't like it. The only thing they cannot do is change the payment rules for pay that has already been earned.

If one party remains in the home and continues to make payments and sometime after the divorce settlement, the home is sold and a profit is made, does half of the profit go to the other party? If the home is not sold at the time of divorce with the above mentioned condictions, is the party remaining in the home under any finanical obligation to the other party, concerning the home?

Whoever gets the home in the divorce gets the debt and the equity. If both parties' names are on the debt and the house is sold for less than is owed, BOTH parties may be liable for the deficiency or, if the lender forgives the deficiency, BOTH parties may have a tax liability for the forgiven deficiency.

The divorce should award the house to one party. The party who is getting the house should be required to sign a "Deed of Trust to Secure Assumption of Loan". The party losing the home should be required to sign a "Special Warranty Deed." The party getting the house should be required to refinance the other party's name from the debt within 90 days or so. The decree should allow the party losing the house to ask the court to appoint a receiver to sell the house if it has not been refinanced within the agreed time period.

In Jan 2012 a judgement was filed against me from Forster and Garbus for a Capital One credit card.I called the law firm and was told I had to have $500.00 down and no less.Iexplained to the woman that I have no job and that I did not have that amount of money to put down.She basically said to bad that's what they wanted.They have since sent me letters that they are looking for assets to seize and banks accounts to freeze. I have since been able to get the $500.00 they want down...spoke with them today to tell them I will be making the payment On 02/29/2012 and I will then send payments.a paymnet plan was not talked about.My question is...after I make the down payment and start making regular paymnets can they freeze my bank account...my husband is the primary holder of the bank account.

If they have a judgment entered against you, they can proceed with bank levy or income execution. A payment plan may put a 'hold' on enforcement of the judgment, but it does not guarantee that further action will not be taken against your assets/accounts. Also, keep in mind that if you miss any of your payments and do not cure within the specified time, the creditor will likely demand that you pay the pre-settlement amount. First of all, I don't think I have to tell you that your boyfriend made a POOR decision in attending a cock fight in the first place. They are illegal and typically aren't attended by the nicest people. In other words, your boyfriend is not a sympathetic victim, other than the extent of his injuries (which NO ONE deserves).

First, you must file reports with everyone in these two counties, even if they are ignored. You must go through the process, even if you are ignored, otherwise it is impossible to escalate. Once you have filed all the necessary documents, there are two things you can do if the local police and DA will not help you. Not much you can do. If she files for divorce, she files for divorce. You can't stop her. The bottom line is that the timing of the divorce versus the timing of the settlement don't really matter a whole lot. A wrongful termination case is primarily about lost wages. Wages are community property up to the date of separation, and separate property after. If the settlement is for back wages that would have been earned during the marriage, it is all community property. If the settlement is for lost wages that extend past the date of separation, some of it will be hers. Not much you can do about that, and whether separation is before or after the settlement will not affect it. Only the terms of the settlement as to what time period is being paid for will affect your rights.

To become serious, you must first consider whether the parties are in privity? That is, what agreement or contract or act or condition makes these parties to a cognizable action? Then ,if there is privity, and a cause of action (basis or bases for suit) then what economic loss has the GC suffered? And if not economic loss, then what other kind of loss is claimed? Hedonic damages? And, on what basis in fact or law?

I'm not completely sure what you're asking, but the effect of the answer on this is probably negligible. It pretty much just says "hey, I'm here, and I don't agree with this". There is no way in Texas for one spouse to stop a divorce if the other spouse wants it badly enough to follow through with the required procedural steps. So if the other spouse is willing to just agree to it, you'd put together a proposed agreed order, request a prove-up hearing setting, and you'd then present the judge with the proposed order for signature. If your spouse won't agree, but there's truly nothing to argue over other than whether you're getting divorced or not, you'd set it for a contested hearing. You might be subject to required mediation (it's a waste of the court's time to have a hearing where that's the only issue), and if that doesn't work, there will be a hearing and the judge will say, "Sorry, but you're divorced whether you like it or not".

I (Petitioner) and my ex (Respondent) attended the first (1st) Hearing in regards to Spousal Support continuation/stop. We are scheduled to return in July at that time Spousal Support Arrears and Spousal Support continuation will be decided. As I got a "taste" by "trying to work out" amounts between my ex with his Attorney and I, I can "see" that she of course is trying to get what her client wants. His Attorney "acted" as if she understood where I was coming from, but then when we got before the Judge, she threw all that information "out the window" and reinterated the "lies and fabrications" they originally filed. Is there a form I can file (prior to the hearing) asking for the "Court" to "decide the matter" as I absolutely don't trust the Respondent and his Attorney; but I both "Respect" and "Trust" the Judge to do the "right" thing because of the way he was during the hearing (fair)? (Short of hiring an Attorney which I can not afford!)

There is a responsive declaration to order to show cause but you also must file a declaration concerning the facts and produce for the court in appropriate form proof of the facts as you want the court to find them. The appropriate question you must ask yourself is not whether you can afford an attorney but whether you can afford not to have an attorney. You are not dealing with an easy case, even for attorneys. Without an attorney you will probably get burned.

Unless the LL has control over the alleged racist parties, I do not think you have any recourse against the LL. You may be able to make an colorable and interesting equitable arguement, of "impracticability", as you could not/did not anticipate that the apt. would not be suitable for the purposes intended, and that you are being denied the right of quiet enjoyment of your leasehold, because of circumstances, which would entitle you to get out fo the lease, and find a suitable rental. This wold all be VERY fact sensitive!!!
