We are considering a rent-to-own option as buyers. The seller said that he and his wife are divorcing. How do we protect our interests so that the rent-to-own contract still remains in effect in case they divorce or if they relocate out of the country? What do we need to ensure is part of the contract?



Answer

First, I assume what you want is a lease with an option to purchase. There are related concepts like a "land contract" or "contract for deed" where you make a commitment to buy, rather than merely getting an option to buy during the lease term, or at the end.

If this is the case, the first thing that comes to mind is that the lease with purchase option, or a memorandum of its key terms, should be recorded with the county recorder of documents in the county where the home is located. This should prevent any sale or other disposition of the property contrary to your rights, or at least give you a remedy if that happens.

Next, the lease with purchase option should contain all the necessary terms, including but not limited to (1) an adequate legal description of the property; (2) identification of the parties, including the landlords/prospective sellers (see next paragraph); (3) a clear statement of the terms of the option, including when and how it may be exercised; and (4) a set of provisions for giving notices to the other party, which will prevent the prospective sellers from dropping out of sight then lawfully claiming that you failed to give them proper notice of your exercise of the option.

It seems to me that you need either a lawyer or at least a real-estate professional to assist you. Among other things, you will want to verify that the people you're dealing with are the sole owners and that you are at least aware of and prepared to handle any liens, etc. that would be superior to your interests at the time you exercise the option to buy.

Actually there is an act of Congress. More than one. Look up [fair credit billing act] and [fair credit reporting act]. Don't Do Stuff Verbally (don't call them). Write letters certified mail return receipt requested in all dealings with them. Demand that they send you a current statement of account. If you do call them, keep a log of all attempts to reach someone, together with the date and time and the length of time you were put on hold.

My ex wife is collecting spousal support and child support even tho she is living with her boyfriend and is pregnant by him. I also recently discovered she has been getting money from my stepdad unknowingly to my mother and I. Bank statements that I have show he gave her at least $20,000 over the past year, while we were still married in fact. She finally got off unemployment and got a job. Originally she was receiving full guideline support from me because she had 0 income. In July 2012 she started receiving unemployment benefits and my lawyer contacted her lawyer to come up with a global agreement to adjust support to correct amount as well as address any and all other issues. Her lawyer delayed it sooo long that it wasn't until December she got back to us. At that time I had to release my attorney due to lack of money. Finally after I submitted new IWO it was changed to correct amount in march 2013. A difference of $461 a month. Almost $4000 I over paid her. My question is: can I make her pay me back that amount? Also since we were still married while she received $20,000 from my stepdad without disclosing that to courts, isn't that community property, which should be half mine? Well I put us on ca lander for adjustment and to be repaid over paid support. Her lawyer called me and asked me to come in to talk to her and try to come to an agreement to keep everything outta court. I went in and she basically only offered to drop spousal support and that's it. Also she took possession of a car of ours that is stated in judgement and leaves me free from any debt or liability associated with that car. Well it was recently repossessed and is not on my credit.... What do I do? Please help

I was divorced back in March of 2010. Under our Mediated Settlement Agreement, it states that " The wife shall retain exclusive use and possession of her leased Honda Odyessy(which is in my name, not hers) and agrees to be solely responsible for any outstanding obligation thereon; the wife agrees to hold the husband harmless from any liability.

My lease is up on my vehicle on 6/7/11, so I will be returning the car, however she has not paid the last 2 payments on the vehicle and has also gone over the milege, so the total comes out to be about $5,000.

My question is that since she has failed to make those last 2 payments am I able to deduct the amount from her alimony that I give her or what are my options here?

Rodgers v. Rodgers, 110 Nev. 1370, 887 P.2d 269 (1994) In 1991 divorce, Mother got custody and Father paid $250.00 per month child support. In a stipulation six months later, custody was transferred to Father; Mother was to pay $125.00 per month child support. Mother moved to California and remarried; Father moved to increase child support.

A Domestic Relations Referee recommended imputing half of the Mother's new spouse's net income to the Mother, and basing support thereon. Mother objected; district court judge (Guy) reversed Referee's findings and recommendation without explanation. Father appealed.

The Supreme Court rejected the Father's contention that NRS 125B.070 grants district courts the discretion to consider a new spouse's income in setting child support, but held that "under appropriate circumstances, a noncustodial parent's community property interest may be taken into account pursuant to NRS 125B.080."

Specifically, the definition of "gross monthly income" in NRS 125B.070(1)(a) includes "income from any source" for a wage-earner, or the gross income from any source of a self-employed person." The Court recited several rules of statutory construction: "It is well settled in Nevada that words in a statute should be give their plain meaning unless this violates the spirit of the act"; "no part of a statute should be rendered nugatory, nor any language turned to mere surplusage, if such consequences can properly be avoided"; when a statute's language is clear and unambiguous, "there is no room for construction, and the courts are not permitted to search for its meaning beyond the statute itself"; if a statute is ambiguous, however, courts should attempt to follow the legislature's intent.

The Court termed 125B.070 "hardly a model of clarity." The Court reaffirmed its holding in Lewis v. Hicks, 108 Nev. 1107, 843 P.2d 828 (1992) that "gross monthly income" does not include a parent's community property interest in a new spouse's income.

However, the Court went on to note that under NRS 125B.080, the lower courts can, upon making appropriate findings of fact, deviate from the statutory schedule, and noted that NRS 125B.080(9)(1) lists "the relative income of both parents" as a factor. In prior cases, the Court construed this provision as including relative standards of living and financial circumstances, and reiterated its holding in Barbagallo v. Barbagallo, 105 Nev. 546, 779 P.2d 532 (1989) that "[w]hat really matters in these cases is whether the children are being taken care of as well as possible under the financial circumstances in which the two parents find themselves. Greater weight, then, must be given to the standard of living and circumstances of each parent, their earning capacities, and the relative financial means of parents' than to any of the other factors." From dicta in Barbagallo, Lewis, and Herz v. Gabler-Herz, 107 Nev. 117, 808 P.2d 1 (1991), the Court inferred that "considerations such as standard of living and financial means may be intimately connected to community income," and noted that under the community property scheme, a spouse has a present, vested one-half interest in the other spouse's earnings under NRS 123.130, 123.220, and 123.225, and under California Family Code sects. 751, 760.

Turning to tax law, the Court noted that the IRS considers half the income and expenses of the community to belong to each spouse, and that such a spousal share may be liable for that spouse's premarital debts under NRS 123.050 and Cal. Fam. Code sect. 910. Thus, while spousal income is not part of gross income, the remarried parent's imputed community property right to share in income does count for comparing "relative income" of the two parents. The Court found its approach compatible with the view of Idaho, New Mexico, and Washington courts.

Here, the district court had discretion to consider such income, but erred in failing to make specific findings, so the case was reversed and remanded for such findings.

Go to second column from left of main screen (The settings area) and scroll down until you see the various BD/DVD parameters. I would suggest placing each one of these on automatic for your initial settings, you can change these later once you are familiar with their usage. However, all of this will be irrelevant if you do not have the proper PS3 system cable in use. From what i remember, my unit came with just a basic composite cable (i.e.: yellow video, red & white audio). This cable does not transmit a high definition signal, therefore, you won't be able to play Blue Ray discs. You need to purchase either a HDMI cable or a Sony PS3 component cable. Both will work fine, although the HDMI is considered the best of the two and it also transmits your audio signal without additional RCA connectors. Finally, you need to go back to that second main column and scroll down until you come to the "Video Output Settings". Click on this and then click the appropriate cable you should now have and then place a checkmark in each box that is consistant with the cable and television you are using. Do not just check the maximum resolution box for your cable/T.V., you need to check ALL of the ones that your cable and television can handle. For the most part, you will put an "X" in all the boxes except the 1080p box (unless you've got a plasma or LCD t.v. that can display 1080p) Mine is an LCD and its maximum resolution is 1080i so i have all boxes checkmarked to 1080i. Anyway.....hope i didn't make a mountain out of a molehill. It's really not that difficult, you just have to explore all the system areas of your PS3 when time allows. Take Care------Ed.

I happen to be on good terms with Burton Neil's attorneys. It depends on what you owe but there is no way that Burton Neil is going to release the funds unless they are somehow exempt from garnishment - either Social Security or unemployment or something like that. However, if you were paying, then why would Burton Neil garnish your bank account? That does not make sense. Did you have a written agreement with Burton Neil? I have agreements with them for several of my clients and my clients pay on a timely basis so there is no bank levy to worry about and I have that written into my agreements with them.

2. Go to each visit. Go to the place at the time the papers say you are to pick the child up. You have to actually go there for there to be any contempt on their part. When you are refused, call the police and have them make a record of the refusal. They will want to see your certified papers. After enough calls like this, the police will eventually refer the case to the DA for criminal prosecution.

3. Hire an attorney and file a motion to enforce the possession order. Seek contempt of court and make up time for the time you were denied.

Games like that are highly likely to get you sanctioned in the form of an order that you pay the other side's fees and expenses for attending the hearing when you had plenty of time to file and serve the amended pleading before they incurred those expenses. Furthermore, in most courts if you don't get the tentative and then notify the court that you intend to appear, it becomes the order of the court. If the tentative is to sustain the demurrer without leave to amend, you will have lost the right to amend and filing an amended complaint after that would be contempt of court. I have never met a judge who will put up with those kinds of games, and even if you get away with it you will have made an enemy of the court.

While the rules state you can file an amended complaint at any time prior to the hearing on the demurrer, you need to understand that the judge and his staff spend time preparing for the hearing, as does your opponent. A great way to distance the court from your position is to waste their time with what would appear to be game playing.

There are enough issues in that little question to write a book about. It is just about one of the biggest mistakes you could ever make for at least a dozen reasons. Just for starters, it would make the loan due and payable immediately in full, and would allow the lender to foreclose. It could make you liable for gift tax on the equity. It will get the property reappraised for tax purposes which could raise the taxes significantly. If you no longer have enough assets to pay your debts in full, including any law suit claims against you, then you AND the person you quitclaim to (it's "quit claim" not "quick claim" because you are quitting your claim to own the property) could be sued for making a fraudulent conveyance. Those are just the top five.

You fail to mention whether the three of you are joint tenants or tenants in common. Since there are three of you, I think tenancy in common is more likely, but three-party joint tenancies are not legally impossible.

OK, I'll answer with an example. Let's say the three of you bought the house 10 years ago for $300,000, taking title as 1/3-each tenants in common. Each of you has a tax "basis" of $100,000. Next, assume the house is worth $600,000 in 2009, and your father dies then, leaving you and your brother each 1/2 of his 1/3. The father's interest gets a stepped-up basis, from $100,000 to $200,000, and you and your brother each get 1/2 of that, so you now own 1/2 of the house with a $200,000 basis. A month later, you buy out your brother, paying him market value ($300,000) for his half.

Your total basis is now $500,000. If you were to sell, your capital gain would be $600,000 - $500,000, or $100,000. The capital gains tax on $100,000 would probably be 15% or $15,000 (the rates may change over time!).

If you hold the property as joint tenants, the survivor(s) will NOT get a stepped-up basis because acquiring an ownership interest under a right of survivorship is NOT the same as inheriting it; in this case you should consider converting the joint tenancy to a tenancy in common (it's rather simple).

If you have lived in the house as your principal residence for two of the last five years at the time of sale, you probably qualify for an exemption from capital gains that would cut your tax liability to zero.

There is an exemption from loss of Prop. 13 assessment value when you inherit from a parent. I don't believe there is an exemption when you buy from your brother, but only his 1/2 interest would get reassessed.

Finally, I see you got at least two other answers, which I glanced at but didn't study. They may be giving you differing opinions, and if so, they may be right, which tells me you should probably get a third, or fourth, opinion.

With respect to capital gains, assuming the house is currently held by you, your brother and your dad as joint tenants, when your father passes, his portion (one-third) will enjoy a stepped-up basis to the value at the time of his death; the remaining two thirds wil not, and when you acquire your brother's potion, it will alter the basis of that portion to the value you pay for it and your own portion's value will remain at the value it was when you purchased it. With respect to property taxes, your father's portion will pass equally to you and your brother without reassessment. When you purchase your brother's interest (which will then be one-half)it will trigger a property tax reassessment as to that one-half.

Me and my siblings took care of his bills and filed his taxes, etc. Three years later I began receiving property tax invoices in my name as an owner of his property. At the time of his death we had no knowledge of this property (In Texas) in his name. I have been paying property taxes for about three years. Recently I was notified by a Utility Company that wants to build a utility line through my (dads) property requiring an easement. My questions are:

For your taxes: It really wouldn't matter much either way in terms of income tax - if you are a single member LLC the business entity is disregarded for tax purposes. However, if you don't associate it with your business you would not be able to claim the deductions for associated business expenses.

As far as your DBA: You certainly could register a fictitious name for your LLC, and it would be treated the same as the LLC itself.

This past year, the Board decided that all the exterior fences, that were adjacent to "common areas" were to be replaced, at no charge, to the individual homeowners. This included both the front and side sections of fencing. However, a couple of homeowner's fences were deemed 100% on the property owner's property, and not fronting onto a "common area". No offer of even a partial compensation was made.

All front sections of every single fence in this community ARE adjacent to common landscaped areas that are maintained by the Association. The same situation applies to those fences that were not replaced. They are no different at all, yet the Board refused to help with any repair expense. I have repeatedly questioned the Board about this, but they won't work with me on this. The Board is very tight knit and will do anything for their "friends" but not "outsiders".

Additionally, I just found out that one homeowner with a 10 foot fence segment that is situated solely on their property, was also replaced, at no charge to them. She just moved, but I do have an email from her stating this fact.

I know it is difficult to win a case against an Association, but I feel that I have a solid case. What do you think???

At first reading, I don't see anything illegal or indefensible about the HOA's decision. Possibly its language is not clear enough or not comprehensive of all situations, or possibly it is not "fair" to all owners, but without reading the actual language I'd guess it would be upheld in court.

Probably not. When you signed your contract, you gave 40% of your case to the firm prosecuting it. If they are doing their job, then you don't have "cause" to fire them. Many times, cases are being worked on behind the scenes without your input. It doesn't meant that nothing has been done. Other times, the insurance company will purposefully delay cases, in order to put pressure on a plaintiff to settle, or to drive a wedge between the plaintiff and the lawyer. My suggestion is that you make an appointment to speak with the lawyer in person to address your concerns.

maybe but you could have a problem. in the case of a conditional sales contract the seller cannot simply declare a default, terminate and evict because the buyer may have "equity" in the property. the risk is that some judge interpets the option price as a down payment and then you have to appeal and who knows what then happens. i suggest you obtain an experienced real estate lawyer in your area and at the very least make sure the agreement is very explicit. you are welcome to call our ken wilk and ask him what he thinks - there is no charge for phone calls. i dont recognize your zip so we probably wouldnt be the ones to actually do it but at least ken should be able to give you another opinion. you can find him on our website rubinoruman.com. good luck.

The real issue is did you or this other person sign any documents that state what the money was for. For example, if this person gave you a receipt for the money, that said the money was "non-refundable", you would be out of luck. Whenever you give someone a significant amount of money, or any oney at all, you should always inquire whether the money is refundable or not. And get it in writing. If this was just an oral transaction, you will probably have difficulty in getting the money returned, unless the person is an extremely nice individual. Have you requested a refund? If not, you should and see what happens. Remember, when you gave this person a deposit to hold the apartment, he/she probably took the rental off the market and might even have told prospective tenants that the apartment was not available. Another factor that is important, is how much time elapsed between your giving the money and your decision to change your mind. If we are only talking about a day or so, and yu promptly requested the return of your money, you might have a stronger case. But the more time that passed, the weaker your case is. Also, another factor is how much money is involved and how was paid--cash or check.

The bottom line is that you entered into a contract with this person--in return for your money, he agreed to hold the apartment. The fact that you changed your mind is not his/her fault. So, in answer to your question, my opinion is yes, he can probably keep the money unless you and this person agreed otherwise and you can prove it.
