The only lawful way to have a residential tenant removed in New Jersey is through the eviction process. You don't have much leverage because of the rent deficiency but you might try to find some way that the current tenant would agree to move by the 23rd. I may be able to help you collect the back rent. My recommendation to the landlords that I represent is to begin suit as soon as a tenant has gone beyond the grace period in the lease. That way, if they want to stay, they will generally have to pay not only the rent that is due but my fee also. If they don't intend to stay, the damage is kept to a minimum. I teach a course in landlord/tenant law at Camden County College and also one on collecting in Small Claims court (starts next Tuesday). You might want to sign up for it.

If there is a mortgage on the property, then you must first check with your bank (mortgagee) to see if there are restrictions on adding a person to title.

The first court date the judge will tell you to hire a lawyer. You work two jobs and you're not eligible for the public defender. There is a possibility of no conviction by having your lawyer ask the prosecutor for theft prevention school. (He never apprised me of the specificity of a $93,000 lien on my settlement and that it would severely impact my settlement check.) The Grievance Committee's action is but one angle on your proof of non-disclosure and incompetence against your attorney. Your action is for malpractice, i.e., proof that your case was worth far more than it was settled for and that your attorney's failure to further compromise your lien adversely affected your recovery. This is a very high bar to overcome. Small Claims Court is definitely not the venue to even consider your case, let alone rule on it.

Is it your personal residence? See IRC section 121 for protections with limits. No, a trust won't help you unless you give the proceeds to someone else on an irrevocable basis before the sale. If this is investment property, you may be able to reinvest the money in a deferred exchange or do a direct exchange under 1031 ( like kind exchanges)

My future landlord has prepared me to sign a lease agreement,where in case of premature severance of agreement I'll have to make up the full amount of the remaining months. Is this legal imposing penalty for nonperformance of contract that way ? Is there a limit? In my opinion, one month is enough for a landlord to find another tenant. It is unclear whether you are asking any question. Are you just venting about your situation or are you asking for advice? I am assuming you attempted to evict the tenant in question without an attorney. The tenant has apparently consulted with an attorney who is making the eviction very dificult for you.

There may be a means for you to achieve your objective of evicting the non-paying tenant before the house is foreclosed upon. But, you have not supplied sufficient facts to determine if they are plausable.

About six months before the order was up, he was arrested and sentanced to eight years prison (having to serve four on good behavior) for sexual misconduct with a minor in indiana. You can not sua sponte terminate your daughter's father's rights. You will need to file a petition to terminate. If the father refuses to consent, as you have indicated you believe he will, you will have to show good cause for a judge to terminate his right's. His being abusive toward you, damaging the car or even 'hanging' himself doesn't carry much weight in this type of action. Those things would be considered in limiting his visitation to supervised visits or something along those lines but not out right termination of his parental rights. Being abusive toward the child and of course the sexual misconduct conviction would be your biggest arguments. No contact would also be an argument but generally a judge would want to see a longer period of time although several years is getting close. However, if he is prohibited from contact with the child due to the sexual misconduct conviction - that argument may get blown out of the water. In my opinion you are close but don't yet have a slam dunk case of sufficient cause to terminate his rights. Your best bet is to consult with an experienced Family Law attorney.

If you file, you will want to have a "mutual restraining order" entered whereby no party can remove the child from the jurisdiction. You must fill out the exemption form!!!!!!! If you do not fill it out within 20 days of it being served on you, you will lose your exemptions. If you have a mortgage on the property, that along with properly filled out exemptions make it very unlikely that they will be able to execute and take your property. As far as the debt, you can always make payments to the Clerk of Court who will apply it toward the debt. Keep in mind the judgment will accrue interest and you might be responsible for costs and attorneys' fees.

I do not check my credit report regularly and today June 2011 I received a call from a collection agency stating I owe $2030. Your will has no legal effect in the care of your child after you die. Any such provision in your will has no effect but to make the court aware of your wishes, which will carry little or no weight. The father will automatically get full legal custody no matter what you do now regarding custody or what you say in your will. For that to change, he will have to voluntarily give guardianship to your parents, or they will have to take him to court and establish that he is an unfit parent and they should be appointed guardians (VERY hard to do if he is not in jail, an addict, or a proven domestic violence perp).

If the fence is completely on his property, yes. If it is on the property line then the cost is shared. [A property line is a mathematical abstraction and has no width, therefore, the fence HAS to be partly on each property unless the posts are totally on one side or the other of the line.]

Your recourse is to put your dogs on long stake out wires. I know that this does not keep the children away from the dogs, but unless you are willing to put up a fence on your side of the line and pay for it yourself you do not have much choice. If you do that you would be giving him a few inches of your property because of adverse possession. IF you do put in a fence, -do not- remove his. He COULD sue you for vandalism, that would probably be his ideal situation - new fence, you remove the old one, and you pay him for the privilege.

Also, by asking him about the fence you have put yourself in a fairly decent legal position, but getting the refusal in writing would help you even more legally. Of course, if he is as smart as I think he is he won't reply in writing. If he did reply in writing that would be evidence that he was on notice that there was a problem and that he failed to take reasonable precautions. (From a Real Estate perspective he does not have to help with a fence, from a Tort perspective if he is aware of a potential problem and does not take action then he COULD be liable. It would be up to a judge to decide which of the two rules to apply - probably Real Estate.)

Your concern does you credit, but you can't force him, if for no other reason than because the dogs are yours. Even if there were no dogs involved you still could not force him.

If you can afford it, I would suggest that you put in a fence yourself just on your side of the property line. As usual, the best solutions are usually the most expensive. You have my sympathy.

If it is your neighbor's, your neighbor is responsible and if it is in such disrepair that it could cause injury, you should consider contacting your local building department. Worst case is if it is your neighbor's and it is in that kind of disrepair as to be a potential source of injury, the building department may have the right to sue your neighbor to repair or remove it. If it is your neighbor's fence and it is partially on your property, you have the right to sue your neighbor to move it at your neighbor's expense, but expect a "survey fight". Alternatively you can put your own fence up on your own property and not rely on your neighbor's fence at all, but then you will be responsible for it.

First of all you can file or make one. Only she can. And if she's in NJ, you'd do one in New Jersey. And you do NOT use a form; you use a lawyer.

The fact that you asked about a POA for someone without assets shows you don't know what one does, and that's a big reason you need legal counsel. POA's deal with assets. No assets, no need.

Things that may be more important might be a health care directive, a conservatorship if her mental capacity is declining and a will. Discuss them all with NJ counsel.

Hello, If someone is arrested for "weapon in vehicle" CT statue 29-38 does that include 29-38d (about when, where and how you can transport an assault weapon) automatically? Or does that have to be listed as a separate charge? Also after reading definition of 29-38 it appeared to me that it was "if an assault weapon was not registered". If you can prove that the weapon was registered according to the new CT law before the deadline will that charge be dropped or can they then say that you where not going to an approved place like a gun range (statue 29-38d) and keep the 29-38 charge even once they verify the gun is registered? Didn't the deed to you and your sister say "in trust for [your granddaughter's name] until she reaches the age of majority, and at such time, legal title to vest in her" or something like that? If it didn't, you'll have to sue to impose a constructive trust and have the title confirmed in your daughter. Examples are things like the first woman working in a all male machine shop who is subjected to nude pictures in the lunch room, sexist jokes, unwelcome touching, etc., and the employer does nothing, or the only black secretary in an office being subjected to racist comments and jokes and other direct hostility for being black to the point where he can't do his job.
