If that is the ONLY thing the HELOC funds are used for, you would probably be able to obtain an order in a divorce that the debt is owed solely by her when the assets and debts are divided up. As between you, her and the lender, however, divorce orders are meaningless, because the lender is not a party to the divorce and not subject to the divorce court's jurisdiction (not to mention the constitutional issues regarding impairment of contracts). So as between the three of you, you would remain jointly and severally liable for the debt until it is paid off. This is why it is essential that if at all possible an order allocating debt to one spouse also require that spouse to refinance into only their own name. That is the only way to get you clear of the debt.

Modifications for child custody and visitation must be filed in the home state. Assuming the child has resided in Connecticut long enough (usually 6 months) such actions must be filed in Connecticut. Child support modifications can be filed anywhere there is in personam jurisdiction over the father. This means that the father has sufficient contacts with a state for the state to exercise jurisdiction over him. Clearly such actions can be brought in New Hampshire. You should consult a Connecticut attorney about filing an action in that state. There is another choice. Every state has a state agency that collects child support. You can ask the Connecticut agency to file a modification to change the child support and they can proceed interstate. They file the action in Connecticut and bring the father into a court in New Hampshire. This is much longer than you hiring a lawyer.

I don't understand this whole situation. While I can understand allowing the friend to borrow a car, why did the car need repairs? Why did the friend not consult you first? This whole idea was idiotic to begin with. I suspect that your friend damaged the car and tried to get it fixed so you would not know and when they got the bill, they balked. Since this is not their car, they have nothing to lose.

Mechanics have liens on cars and if payment is not made they can and will sell your car to recover the repair costs. I don't know what the car is worth or what the repair costs were but if the car is worth more than the repair costs I would arrange to get the car back and then deal separately witth your soon-to-be-ex friends. Friends don't screw over friends.

I know with that kind of debt burden and the low interest rates supposedly available today that it must be cery tempting to refinance. Unfortunately, along with low rates have come very demanding and suspicious lenders who want borrowers to have significant equity (20%) and good income and credit scores. On the fortunate side, you have five years (perhaps) to shop for refinancing and perhaps come up with a way to reduce the balance you need to borrow or put more equity into the mix. One suggestion would be to take all your documentation to two or three loan brokers in your area to see if they represent any lenders who'd be interested in your particular situation (principal sum needed, appraisal, income, credit rating, etc.). My sense is that the refi loan market is pretty unfavorable for borrowers who are significantly "under water" right now, but local brokers might be able to help if your income and credit ratings are favorable.

Either way you should file some document asking the court to set child support sooner rather than later. Your primary question is which way to file: with CSED or without CSED?

If the uncle repos the car, he is stealing it. You should report the theft to the police, and tell him ahead of time that you will do this.

By the facts you describe, your have clear title to teh vehicle, and he holds no secured interest in it. But, he can still take you to court on the alleged debt. Just because he has no lien on the vehicle, does not mean that he might not be able to prove that you still owe him some money on the loan.

If it was an officer, they will obtain your IP address from your internet provider and contact you. If your question is, can you be charged with a crime, the best answer I can give you is "possibly." I think the police would have to be creative though because you are not an adult.

My suggestion is that if the police contact you, you would want to have a lawyer with you when you talk to them. Also, it is probably best to tell your parents, especially if the police come around asking questions. They could potentially think it is an adult male in your house doing this and question them.

You do not mention if there was any promise to get you the photos by a specific date as part of your contract. If there was no specific date promised, there has been no breach of contract yet. Assuming you receive the photos, I don't think you have a case. You can still use the photos. They preserve the way your daughter looked at that age, which means you will have received the product that you purchased. If it takes a few weeks longer, you could say that the contract was not performed within the time period contemplated and file a claim to compel production of the photos or a refund.

My divorce agreement states (paraphrase) "husband shall maintain health benefits for benefit of wife for so long as she is eligible to remain a covered person under said policies and under applicable law." It also says that I need to provide notice to my benefits admin within 30 days of final judgement to tell them I'm divorced and preserved wife's cobra rights. Several days after final judgement, I called my benefits admin and they told me there was no option to keep her on policy, and she would be mailed COBRA paperwork. Divorce agreement stated I am to provide in writing to wife all options and obligations available to maintain coverage. I thought I satisfied all the requirements. a.) I notified my employer within 30 days that I was divorced. b.) I asked them what options were available for ex-wife c.) I was assured COBRA would send her available options in writing. She is now taking me to court on contempt, charging that I willfully and deliberately removed her from the insurance without notice and never provided her any of the options. I called COBRA, and they couldn't give me any specific info due to privacy laws. However, they told me the COBRA packet was returned undeliverable with no forwarding address, so she never got the COBRA paperwork. I believe I did everything that was required of me and followed the requirements in the divorce agreement. Could I please get someone's opinion on this? Thanks

In Connecticut, only assets that would have passed through a will are affected by intestate succession laws (such as a car). Many valuable assets do not go through a will, and therefore are not affected by intestate succession laws. This includes your daughters 401K, or other retirement accounts. The 401K will pass to the surviving co-owner or the beneficiary named on the document. It does not seem as though your daughter was married, so it is likely the 401K will pass to her named beneficiary.

Assuming your daughter has no spouse or children (as they are not mentioned), intestate laws state that the parents will inherit everything that would have passed through their child's will. This would include your daughters car. You can simply pass that along to your daughter's nephew if you see fit, in regards to your daughter's intent.

Without conducting further research, it is my understanding that the transfer of ownership was effective upon your aunt's signing the deed. In Massachusetts, a deed does not need to be recorded in order to be effective as between the parties. If the home has not been sold or transferred to another party, you may still have a right to one-third ownership in the property. However, if the property was sold or transferred in good faith, with neither the seller nor the purchaser having any knowledge of this unrecorded deed, you will not have as strong a case, if at all. The answer to the ownership question will also answer the property tax obligation question. My office handles real estate disputes, including partitions, and I would be happy to speak with you further.

Can you fire your attorney? Yes. Will you therefore get the whole settlement? Probably not, for two reasons. First and foremost, you likely signed a contingency fee agreement with your attorney that allows your attorney to recover his or her actual expenses (phone calls, copies, accident reports, medical records, etc.) regardless of whether or not you recover anything. So at the very least, the attorney will be entitled to what he or she actually expended. Second, because you would not be unrepresented, the insurance company would not offer you the same amount. They made an offer based on the fact that if you didn't like their offer, your attorney could file a lawsuit against them - and in turn, they'd have to spend money defending that lawsuit. If you fire your attorney, you lose that leverage - and therefore, the insurance company can then safely make you a low-ball offer.

If you won the appeal, then why are you on probation? If you pled guilty or no contest, then the charge doesn't go away and you can't sue the cops if you have pled out to the charge. It may be possible to get your probation terminated early but there is not enough information on here to answer that question. You should contact an attorney to find out more information.

Frankly, who is going to believe that a person with a CDL license would drink at the scene of a accident after the accident while waiting on the State Patrol. (It is possible to have a DUI arrest on private property). Your refusal of a test is almost certainly going to get your license suspended.

You need a lawyer, and be sure to tell him what actually happened so he can properly assist you with any defenses.

Depends on the judge. If you can scrape some money to bring yo hearing it would help your story. Bring witnesses and documentation of what you have done looking for work your homeless period etc. If you haven't filed a modification of support you should do so.

The police came and did a report and she admitted liability but her Aunt is the actual policyholder and the adjuster has not been able to get in touch with the Aunt (for over a week)and therefore refuses to fix my truck or pay for a rental car until the Aunt communicates and accepts liability. The smart move is (1) report the offending insurer to the state insurance commisioner and let the adjuster know you did that. (2) If that does not get your car fixed, involve your insurance company. That is why people carry their own insurance.

Small claims court would require you to spend time and money, hope that the other driver really is insured (or if not, that you can figure out how to collect your judgment) and would delay getting your car fixed.

My sons have a trust fund where an Attorney is Executor. My Grandmother passed away in 2002 and my sons are now 19 and 16. I have asked on several occasions for an Accounting of the Trust and have never received one, except for the initial Assets. We have also never received any fee notice. What rights do my sons/Ihave (legal gaurdian). We would like to have her removed and a new Executor appointed. How should I go about this? Thank you so much for any help you can provide.

The trustee has an absolute duty to account. Most trusts require an annual accounting, so read over your document and see what it says.

Once you have read the trust, send a very business-like letter by certified mail to the attorney, in which you quote the language of the trust, set out the dates on which you had previously requested accounts, and request that an account be produced within a reasonable amount of time (say, 30 days). Since one of your sons is over 18, he will need to sign the letter on his own behalf, and you will sign on behalf of the minor.

If you do not receive an account, the next step is to file petitions for an account and the attorney's removal at the Probate Court. You probably should hire an attorney with experience in probate litigation to help you with this step.

In general, Executors are required to file an Inventory within four months of appointment, and an annual accounting of estate transactions. In practice, the Inventory and first account frequently await settlement of the estate and passage of a year, because of the need to allow time for any creditors' claims against the estate to be presented and or suit to be filed.

However, an interested party has the right to require filing of an Inventory or annual account. If the Executor is unresponsive to a certified letter requesting the filing of accounts, it would be advisable to contact an attorney for further proceedings, although a request pro se could be made through the assistance of probate court clerks. (If the letter doesn't work, it suggests that litigation may end up being necessary, and getting an attorney involved early would be helpful.)

In addition, testamentary trusts (a trust set out in the will rather than a separate trust agreement) normally require annual accountings, in a similar fashion to the estate. In either case, the executor or trustee needs to file a final account to be released from their bond.

If an executor or trustee fails and refuses to file accountings, that may be cause for removal. Again, it would be easier to do this in association with an attorney, as probate court clerks are not supposed to give legal advice.

Finally, if it is not a testamentary trust, the trust agreement will specify what obligations the trustee has to account, but in all cases, the trustee is a fiduciary and must act with the interests of the beneficiaries in mind. If a trustee fails to do so, he or she can be removed.

Depending on how the account was set up, you may already have access as her parent. If they require an estate administrator, this may cost a few hundred dollars to do through the probate court, which may not be as much as in the account. If it is, and they require an administrator, you can probably do this on your own by getting the forms from the probate court, filling them out and filing them.
