Are there any laws in California related to sales closed after an sales rep leaves a company? I am about to leave my current employer but I have business slated to close soon. I have performed all the solution design work and provided quotes to my clients but the purchase orders won't be received prior to my last day of employment. The owner of the company is offering to pay me for business closed for up to 30 days after my last day if I stay a little longer. My comp plan is commission only based on 60/40 split of profits so there is no base salary.

There are a several different ways to do what you are seeking. The first is to carry the entire mortgage and they make monthly payments to you. You will either have a first mortgage/lien on the property or you can retain title and then transfer title to the buyers upon full payment of the loan. This method only works if you do not have a mortgage on the propery.
The second method is to loan the downpayment to the buyer and take a secured note and deed of trust against the property. It would be best if the bank lender agrees to take their note in second position allowing you to foreclose if the buyer fails to pay you. However, you would need to disclose this transaction to the bank lender and they may not agree to loan money under these conditions.
The third way is to loan the money and obtain a secured note with deed of trust and to file the deed after the bank lender files their deed of trust. The problem with this solution is that if the buyer defaults against you or the bank, you may be out of your money under a foreclosure.
You could accept collateral but you would have to take possession of the property and keep it well maintained until the loan is paid off and then return the collateral in the same or similar condition you received it. That is a risk that you will have to be willing to accept.

You would want a deed of trust secured by the property. The problem is that the bank will likely be in first position, and there won't be much equity in the property, so you might lose that security if the buyer failed to pay the mortgage and was foreclosed on.
You can take a lien on a car or other personal property. You just need to be sure that the car has sufficient equity to make it worthwhile to foreclose in the event that the buyer fails to make payments.

I have no idea what world Mr. Jordan lives in, but the main/commercial lender would NEVER agree to subordinate their mortgage to yours. That would be insane. It is fairly common for a seller to "carry back" some portion of the purchase price. All you do is make sure that is included in the purchase/sale agreement and that the escrow company prepares a note and deed of trust. It is no different than a commercial second mortgage except you become the "lender." As one of the other lawyers mentioned, however, this is a tricky place to be. If the buyer defaults on the main loan and they foreclose you are wiped out. Under California's anti-deficiency laws you wouldn't even be able to try to collect the balance you would be owed. As for adding additional collateral, that would protect you from the weakness of a second mortgage, but would make the transaction immensely more complicated. If you want to go that route, you would need the assistance of an attorney to prepare correct documentation and ensure everything is recorded properly.

You don't say where you got the divorce. If in California, I can't answer the question - because I don't know, and because I can't advise you on California law. If you got the divorce in New Mexico you are required to exchange financial information annually. Her new husband's income does not figure into the child support calculation, hers does. If she is not working you can impute income to her based on what she could reasonably earn.
Without more knowledge of your situation I can only give you the general rules here. This is a complicated area and I would suggest you talk with an attorney who can give you advice tailored to your specific situation.

I am not sure that I understand your question, but the house will be considered part of the marital estate. If you would like to keep the house, then that is what your lawyer will try to accomplish for you. You may, however, have to pay out part of the equity in the home to your spouse to get her to agree and if there is no agreement, the court may order you to pay a portion of the value for you to keep the home.
The best I can say is to consult with an attorney. Equitable distribution claims can be very complicated so you would not want to try this without a lawyer.

A person may not write a check for more than he has the ability to pay. That means either knowingly doing so, or giving a blank check, if you do not have the funds sufficient to covert it.
However, if the amount of the check that you had completed was subsequently altered without your knowledge, that can be a defense. You will have to show that the check was altered and that you did not alter it.

Under North Caolina law you cannot file for divorce until you have been separated for one full year. Therefor you do not need to do anything until that year is up. Then I suggest you hire an attorney.
You could try to enter into a separation agreement if you want to divid property, but if you truly do not want anything, and there are no children, then you just wait out the year.
After the year, you can have an attorney file a complaint for uncontested divorce.

It depends on the specific facts of your case, but if the county owned streets are within the borders of the HOA, then yes, the HOA typically has the right to make reasonable rules and regulations about parking on that street. Read your Declaration of Covenants, which you received when you purchased your home (and if you didn't receive one, they are filed in Harford County land records, which you probably access on-line). Also, you might be able to get your hands on the deed from the HOA/developer to the county where by the HOA/developer gave the roadway to the county (likely because the HOA didn't want the responsibility and expense of maintaining the roadway) and see what it says, if anything, about the HOA's right to makes rules and regulations pertaining to the road.

Because of this water was leaking through the retaining wall which holds up my condo due to improper drainage. After a few phone calls, the HOA did a small fix but I do not think that it will solve the problem. Who is responsible for this type of repair to have proper drainage? It seems the HOa is responsible since they already did a fix but I have received two independent consultations and both feel that what was done was just a waste of money and will not solve the problem. I do not feel I am responsible for water drainage of the common area and that the HOA should have known better and had proper drainage to begin with. I have lived in the residence for under two years and feel that if this is just getting fixed, there could be 25 years worth of improper drainage compromising the retaining wall/foundation.

Without the benefit of an on-site inspection after reviewing the HOA rules, etc., I would have to say this is probably an HOA-responsibility matter. At present, you don't really have a claim, since there is no current damage (as I understand it) that you could sue over. However, you might consider writing a letter to the HOA, expressing your concerns that lack of proper repairs may subject the HOA to a much bigger claim in the future.

I am an Austin Divorce Lawyer, but I have represented several "statutory rape" criminal defense clients.
In Texas a person under the age of 17 is considered too young to consent to sex...BUT there is an exception if the other person is within 36 months (3 years of age).
Basically, start with your boyfriend's date of birth and start counting months until your birth...if you get over 36, then YES he is committing rape (even if "consensual"). And he could be charged and convicted of a felony.
If he just turned 19 and you are about to turn 17, then you are ok...but if you just turned 16 and he is about to turn 20 then you could have problems.
Also! It is also illegal to have nude photos of anyone under 18. So even if it is ok for the two of you to have sex, it could still be illegal for him to have any nude photos of you (NO EXCEPTIONS).
Bottom line: Sex with someone older if not worth the risk..just wait until you are at least 17 (or longer).

Private schools can contract with you under different rules than those applying to public school students. If the contract or course bulletin/catalog for your daughter's private school permits the principal to prohibit a student from taking classes outside the high school's course offerings, then you have agreed to that as a condition for enrollment at the school. If there is no such provision in your "contract" with the school, then the principal cannot--after the fact--make this prohibition.

The answer to your question is, yes, your attorney can only make demands or accept offers with your permission. Without knowing exactly what you or your wife told him, or what you gave him permission to settle for, I do not know if your attorney violated his duties to you.
In my opinion, however, an attorney in Colorado should take any case involving a settlement with a minor should go through the probate process, whether the settlement is for more than $10,000 or not. Something that many people do not know is that money received by your son in settlement of his claims is his money alone, and you cannot use that money to satisfy your obligation to support him. It should be placed in trust for his benefit. I would need to know more facts, but there is a decent argument that you are not entitled to repayment for gas or other expenses to take your son to school because you have an obligation to do that as his parent.

As much time as you want. He is a tenant at will. There is no time period, but I would give him a reasonable time in a notice to vacate. I would tack a notice to the door or give him written notice personally. Depends on your relationship with him but you could be generous and give 30 days or less so and give 15 or even less than that. As a practical matter though, its really hard to just pack up and get a new place to live with only a week's notice.
For actual tenants, its 15 days for a lease of 1 year (unless its for nonpayment of rent in which case its 10 days) or less or 30 days for more than a year. This is not an actual tenant but a tenancy at will which means he can stay so long as you allow it.
You should indicate in the notice that the tenant's mother was permitted to stay there but as she is now gone, you desire to recover possession of the property so the tenant has x days to leave the premises or you will have to evict him.

At some point the School District will cite the student as a truant and can refer the student to Juvenile Court. If as a parent you are unable to get your child to go to school you run the risk that the Juvenile Court will declare that the Student is a dependent of the court and remove custody.

If you do not believe her charges are reasonable, you can file an objection with the court and the jusge will decide what is reasonable. Most people believe serving as an executor is a lot of work and a significant responsibility. Also, carefully read the will to determine if your step-father left any guidelines to determine what is reasonable.

It doesn't matter whether you have a "legal letter" or a document signed by God. When it comes to custody of the children, such matters are always subject to the courts if one party or the other files a custody petition.
Child custody is based on the child's best interests. Anything and everything bearing on the child's well-being is relevant. So while you may have the letter and it may provide some evidence, nothing precludes your ex-husbande from going to court and requesting custody/visitation with the children.
Once a court order granting custody/visitation is entered, it may be modified based on a change in circumstances.

First, this isn't real property. Real property are things like land and houses.
That said you have 2 different problems. The first you are as responsible for paying the car loan as he is. The bank isn't going to let you off the hook especially if the boyfriend isn't paying they are going to look to you. Even if you took your name off the title the bank is not going to care.

The answer depends on how title to the property was held, and whether your husband had a will. For example, if the title was held by both of you as joint tenants with right of survivorship, then you would have become sole owner upon your husband's death. If you did not have survivorship rights, but your husband had a valid will that bequeathed his share of the property to you, you would also become sole owner. In either case, the property would be yours to dispose of as you wish.
However, if the property was not held in joint tenancy with survivorship rights, and your husband died without a will, a court will have to determine the ownership of the property in an heirship proceeding. The title company will require some sort of proceeding to show that you are the owner of the property. I do believe you are supposed to pay to use their course though. Again, not sure this would be considered a theft in the eyes of a cop either. If there is no paternity established you can't get a custody order, because it would make no sense. If he is not legally on record as the father, it makes no more sense to ask for an order granting you sole custody against him as asking for one against any random man on the street. Custody orders are only issued between two legal parents. So without paternity there can be no such order.

We both filed bankruptcy and both were granted and we have the papers that show the amounts of these liens has been dismissed in the bankruptcies - we are no longer responsible for them. We have went to the bankruptcy court, recoreders office etc to see what we needed to do to have these removed - they bring up nothing on our reports showing they exist. I read your question as though you sold a home, and carried back the purchase price with an owner carry back promissory note. I hope that this promissory note is secured by a deed of trust. Either the promissory note or the deed of trust should contain a clause regarding the payment of property taxes. A failure to pay property taxes can be treated as anything from a breach of the obligations which triggers foreclosure under the deed of trust, or even a right for you to pay the taxes and then add that to the debt that must be paid to satisfy the note.

Your post sounds like you already lost a case, which is usually what happens when people proceed without a lawyer and the judge has decided you will also have to pay lawyer's fees for the other side, again probably partly because you failed to have a lawyer and properly handle your case. The judge has apparently asked for that to be submitted on briefs. If you seek a hearing, you will likely jack those fees way up, as you are essentially ignoring the judge. You probably have cost yourself a great deal by doing something that is never a good idea (being pro se). You might get some limited help now by paying a lawyer to assist you with your brief. But if you want to take your tact instead and defy the judge, expect your train wreck to get even worse.

It sounds to me like your friend went back to court with a "Motion to Revise or Revoke" her original sentence. The idea there is that justice was not properly done with the first sentence, and that the sentence should be changed. As you might imagine, these motions are filed by people who want to have their sentences reduced or thrown out altogether (which the court will do occasionally), but the potential downside is that the court can also increase the sentence, and the filing of a Motion to Revise or Revoke also comes with that risk.

You would need to file a paternity petition so that you can have a judge order custody and visitation orders. I don't think the schedule you suggest (if I understand it) is appropriate for a 10 month old. Babies that young should not go extensive periods without either parent. California courts have a website, and the L.A. Courts have a pamphlet suggesting an age-appropriate parenting plan:

Why is the car stuttering and losing power going through the gears 1999 626-- auto?
Naturally enough it could be a lot of things. Assuming the car's timing is okay (you've had it serviced recently right?), if the stutter is caused by a misfire then you need to look at the ignition system -- in your situation this will often happen if you accelerate really hard (i.e. put your foot to the gas) and the engine sounds/feels like it's about to stop.
Start with the spark plugs to make sure they're clean -- no build up of gunk around the point or any burn marks (shudder). If they're not looking good replace them and see if that helps.
If the plugs are okay it might be the ignition leads, which go from the top of the engine to the coil -- there's a lead for each cylinder and the coil is a little box thingy on the front right of a 4-cylinder '99 626. Unfortunately if it's the leads you're not going to know until you replace them. But it's cheaper than the coil....
Next is the coil. If you've made sure the plugs and ignition leads are okay and the problem persists, you might need to replace the coil.
All these things you can do yourself, but beyond that you'll need to see a mechanic.
Another possible issue that comes to mind is a seriously dirty transmission. Have you had that serviced in the past 3 years...? If not that could also be an issue.
Hope that's of some help, but as before, with cars the problem could be any number of things.

Get a family law attorney to draft a QDRO for you. These have to be carefully drafted to comply with the plan administrator's rules; its not something you can do on your own. It should not be all that expensive for a family law attorney to do it.

It depends and I will say its most likely neither illegal nor the "good ole boy" network...it is unadvisable.
If the attorney had represented the previous party, then he was right to decline representation of you. If he sent a letter to his former client that you may sue him and only said this, he probably broke no ethics rules...although I probably would not have done the same thing.
He would be at fault if he met with you learned facts about the case and provided this info to his former client. If he did not do this, then it is unlikely he broke any rules.
He is right, slander cases are very difficult to win and even if you do collection of the lawsuit is not the easiest thing to do.

As a lawyer, I have to be very cautious so that I don't give inaccurate advise. You stated that the final date for pick up has come and gone several times. But you didn't provide any specific information. So I don't know if the last pick up date was a week ago or a year ago. "Peer" does not mean "someone who is very much like the defendant." Instead, it means someone chosen more-or-less at random from the same region. Defendants are entitled to jurors who are selected fairly from a pool that is chosen in non-discriminatory ways. That does not mean the jurors who end up on a given case will be like the defendant. The jury can't be tailored to exclude people who are like the defendant, but it also can't be tailored to exclude people who aren't.
Your question considers only the defendants' ethnicity. But even if you see people only as members of groups rather than individuals, ethnicity is just one of many ways to categorize them. They could also be grouped by religion, gender, age, socioeconomic status, etc.
Let's say a defendant is a middle-aged, liberal, Asian, female, Buddhist, gay, college-educated, overweight, non-smoking, physically disabled retiree. She is not entitled to a jury of twelve other middle-aged, liberal, Asian, female, Buddhist, gay, college-educated, overweight, non-smoking, physically disabled retirees. Imagine how hard it would be to find twelve such people in a jury pool. For that matter, imagine how hard it would be to find twelve who are young, conservative, white, male, Christian, and straight. Even finding twelve who are white, male, and Christian would require dismissing dozens of other potential jurors. And if a case had multiple defendants who weren't members of all the same groups, it would be literally impossible to give each of them 12 jurors like themselves.
Besides, who's to decide how to even draw these categories? Where some people see one category of Christians, others see Protestants, Roman Catholics, Eastern Orthodox, etc. Where some see one category of Protestants, others see Episcopalians, Lutherans, Baptists, etc. Similarly, where some see only Asians, others see Chinese, Japanese, Korean, etc. And where some see only Chinese, others see Han, Hui, Tibetan, etc. (And there is lots of room to disagree about whether Tibetans should be counted as Chinese at all.) So there would be insurmountable line-drawing problems even in a system that worked the way you suppose.
Imagine how such a system would play out. Could a court justly exclude jurors based on their race, ethnicity, sex, religion, etc.? "Juror No. 12, you're excused because your skin is the wrong color." Our courts do not work that way.
The fact that those two Hispanic defendants had a mostly-white jury does not mean their rights were violated. Unless the prosecutor or the courts tilted the playing field against Hispanics, I don't see an issue.

The US Supreme Court has ruled that lawyers cannot use race as a consideration in picking jurors. For example during voir dire in this case four Hispanics are questioned and the DA excludes every one of them without good cause the Hispanic defendants have a right to disqualify the jury and start over. Likewise say the defense attorney feels that African Americans should not sit on this jury and excuses every African American based solely on race the DA can ask for a mistrial.
