Question

I have a misdemeanor theft charge from 2005. I want to go back to college to get my teaching degree, but am worried that I might not get hired as a teacher in the state of Texas with the misdemeanor on my record? If so, what can I do to get it off my record, or is it okay?

Answer

If there is no conviction, then there is nothing on your record. If there is a conviction or a resolution of your case, there may be a problem.

If you have been licensed already, or if you received federal aid or a federal grant in college, it sounds like this may not be a problem.

Probably the best way to discover whether there is a problem is to phone the HR department of a local school or your college.

If there is no conviction, it may be possible to resolve the charge so no conviction appears on your record. You will need to hire a criminal defense attorney in your area.
