No. You likely cannot get it dropped down at your arraignment. At the arraignment, you will have the opportunity to plead guilty or not guilty to the current charges. Plead Not Guilty and hire a lawyer. Your lawyer may be able to get the charges reduced or in the best case, dismissed. Without investigating the circumstances of the case, there is no way to tell you exactly what could happen but a good OWI attorney should be able to help you.
After pleading not guilty, the court will set a date for your next court appearance which should be a pretrial conference. Make sure you have an attorney before that. I wish you luck!

The answer is "it depends." In general, when a person or business throws something in the garbage, it is fair game for the general public to "dig" for it. On the other hand, it depends where the dumpster is located -- if you have to break-and-enter or trespass to get to the dumpster, you may be criminally liable if caught. Some counties have specific anti-dumpster diving laws as well. I would be careful engaging in this type of activity.

Check your trust document. Normally a trust document would specify the trustee fees. If not, then you are entitled to a reasonable fee, based on probate code 15681. What is reasonable depends on the asset of the trust. Typically, a 0.75-1.25% of total asset, or $5000, whichever is greater, is considered reasonable.
You do not have to send everyone an accounting. You should keep an accurate accounting and prepare to show to anyone who may ask for it.

On Sat, March 30, 2013, I got up to go to the hospital to see my Grandfather that had experianced a heart attack, my car didn't want to run so I took my motorcycle (I am not motorcycle endorsed). On the way back from the hospital a vehical (siver Volkswagon) pulled out without looking and almost took me out, I had to apply both brakes and lay my mototrcycle down to avoid being hit. I then got off of the ground and went over to my motorcycle and had some trouble starting it (probably flooded it while being on its side) when the motorcycle finaily started i looked up to pursue the siver vehical. I continued until i came upon a university officer i stoped to tell him what happened but he wasnt getting me so i continued forward, he then proceeded to check my speed away from him whilest I went towards my apartment. I left my apartment 2 min later after realizing i needed a little more than water to clean my wounds. After leaving my apartment i was pulled over for speeding (not then but when i left the officer that i told i layed my bike down) and givin a second ticket for no motorcycle endorsment. I was told that i could not ride the bike back and would have to push or tow it (understandably). I dont have extra money for a tow truck so i went with the pushing option, i asked if one (of the five) officers (four patrol cars) would help carry my helmet because i could not push my motorcycle and carry it, they refused. I then called 911 for assistance, they put me through to the officers that were on site that had already refused to help and so dispatcher hung up on me. I had to get my father to get my motorcyle, and my father said they were smiling and laughing at me when he went by them.These officers did not care in the least bit about my well being......................****Question is, Is that not neglecting to help a person that needs help? Is that not there job? Is there any way i could sue for neglect? or are they just playing by the book?

It is also possible, as in some plans, that if there is no surviving spouse, there would be no further payments made to anyone.

You failed to tell us how the wrong medication caused you additional pain or discomfort (severe enough to sue someone for it), or additional medical bills, or anything else, or will cause additional medical expenses in the future. A mistake with no real negative consequences is not an opportunity to collect a big paycheck, if that is what you are asking (though like most areas of law, there are la few lawyers who will see it as an opportunity). If you do want to see a lawyer, there are several in the Atlanta area and larger cities, who primarily handle medical malpractice (not dabble in in with divorce, criminal, bankruptcy, real estate, etc.). The mistake should be brought to the attention of the hospital so they can make sure they have procedures in place to avoid a case with real potential damage.

When I moved in, we put a pool in, I paid the down payment with my own money and got the pool loan in my name only (he did't have credit at the time to do so). Last year we added a pool house using a HELOC that is in both of our names. In 2011 we merged our bank accounts band were jointly paying both loans and I was paying half of all the house payments, etc. (even prior to merging bank accounts). He got a new job in Chicago and moved there in January (still has primary home in MO). He asked me to move out, which I did, March of this year, but will not assume the pool loan, which still has a considerable amount on it, and will not refi the HELOC to get my name off of the loan. I am also on his car loan. My credit is over 800 and I do NOT want to get it ruined. I just want this all to be over with. I am not going to continue to pay for anything that is no longer my asset or that I no longer am allowed to utilized. I need professional guidance. Court ordered visitation cannot be changed without a new court order. Would a court entertain a change that only effects 7 days out of a year? Generally no, but you could spend a few thousand dollars trying to find out. A simpler solution would be to talk to the other parent and see if they would voluntarily divide the holiday differently. While that is not court enforceable, it's cheaper. Bear in mind that if you file a case now, it may not be completed before Christmas.

You cannot take your minor child out of the country without a passport. In order to apply, your husband must be willing to sign the application or provide a notarized statement.
If he is not willing to do that (and I would not if I were him), there are no cheap and quick solutions. You will have to bring an action for a divorce from bed and board and get awarded sole custody of the child. Then you can apply for the passport provided that the order allows you to travel outside the country with the child. Again, the father may request that this not be allowed. If that happens, then you are stuck. The courts just are not going to let people leave the country with their children.

When you say "taking you to court" I assume that you have been served with a Summons and Complaint which recites that you must "answer" within 30 days. This is standard procedure for a creditor to exhaust its remedies to collect. If you do not serve a responsive pleading, that is send an Answer or some motion (such as To Dismiss, To Quash Service, etc.) then the court will enter judgment for the requested and proven amount. The judgment order constitutes a lien on real property in that county. It can be extended to other counties and can be transferred to other states as well. The creditor can then serve a Notice of Exemptions which allows you to exempt your personal and real property from the Sheriff and his collection authority which follows the judgment. The judgment is valid for 10 years unless renewed.
Thus, from an immediate standpoint. You could defend by stating your defense in a document that shows the heading or style of the case which shows the parties, court and case number. The court will schedule a hearing for any defense. You have a right to contest all of the collection techniques and abuses if any as well as to require that they prove the amounts as correct. If they are legit and honest, they should eventually end up with a judgment if they spend the time and money to jump through the legal hoops and legal obstructions you impose.
Options:
1. Negotiate a deal. Agree to make some kind of payment, which could begin in the future. The creditor will likely want judgment and terms of settlement incorporated in the document. Do not agree to a reference to "contempt" in any settlement agreement.
2. Do nothing, allow the judgment to be recorded. A future bankruptcy will render the judgment void. You will be able to avoid the lien on property in the bankruptcy also, but it requires a motion in bankruptcy. Prior to taking this option, look at the exemptions to be sure you can exempt all of your equity in your property. (You can find them in North Carolina General Statutes 1-C-1601)
3. Look at possible defenses and serve your answer or motion on the Clerk of Courts and the lawyer who filed the complaint.
4. Remember that a judgment will go on your credit record.
5. If this is a collection agency or assignee, check to see if the suit is prosecuted in the real party's name. That is that the owner of the debt is the Plaintiff and that they are licensed to collect in NC.
6. If they are an assigned or bought the debt. They will take a cash settlement, often at a small fraction of the principal amount, say 40%.
7. All of these elements of this reply, has a lot more detail associated and may or may not be applicable to your situation. You should consult a lawyer, even if it costs $50 or $100. Many lawyers, in the bankruptcy context, will consult without fee.

If it were discovered that a residential area had been built, without anyone's knowledge at the time of its development, over an ancient cemetery or burial ground, that discovery would probably have some negative effect on property values. 90% of the owners and prospective owners wouldn't give a hoot, but if 10% would be spooked, more or less, by the known or suspected presence of an ancient burial ground, that would be enough to reduce demand and thereby bring property values down a bit.

You have really asked two questions. The first question you ask is whether he will be released from custody or whether he will be held in jail pending trial or further procedures. The court may release him on his own recognizance (OR) or set a bail. If he is released on OR he will be let out of jail and given another date to come back to court. If a bail is set you may either pay the bail or go to a bail bondsperson and bail him out for eight to ten per cent of the bail.. If he is not bailed out he will remain in custody at least until the final disposition of the case.
The second issue is what will happen in his case. It is unlikely that he will be sentenced on Tuesday. Most likely he will enter a plea of not guilty and a future court date will be set.

It is very hard to give you any good answers because you didn't tell us many important things about your case. Ventura County DAs are sometimes brutal, and you can't just count of the matter being dismissed. If you have a lawyer and are willing to fight the DA and have a judge dismiss the case, it is very possible that it could be dismissed, but that depends on other stuff you don't mention. If the case is dismissed, then there will not be a license suspension. The question about your boyfriend's speeding is also hard to answer, because the total situation must be analyzed in order to know what is best for you. I recommend that you consult with a criminal lawyer experienced in medical marijuana cases. Most criminal lawyers give free consultations, but not all criminal lawyers are experienced with med MJ cases. I have handled many of them and would be happy to meet with you. Either the car started to move and stopped or I though it did. I rearended the back bumper of the car. No police were called and no police report was made.
The girl driving the car, was the teen daughter of the owner of the car. I never spoke to the driver, however, my husband did see her sitting in the driver's seat. The mother said we did not have to call the police but could exchange information. She said that I probably thought her daughter was moving, but being a new driver she had been hesitant. I gave her my name, number, car tag number and insurance company. She said she could live with the bumper damage, but would contact me.
Almost five days later, I heard from her. She said she had an estimate and would send it to me. I texted her my email but did not offer to pay anything. When I got the estimate, it was $775 which I thought was excessive. I have yet to contact her back despite here contacting me.

1. Money in escrow? No unless the contract called for it or there was a municipal development agreement that was the enabling document for the development in which setasides for this purpose was required; most don't, some do (especially if there was some kind of municipal incentives involved and that would take some research).
2. Builder is responsible and if shuttering, you have an unsecured claim.
3. If there was a performance/completion bond, you should make that claim now if possible. If there was a public setaside, that too should be addressed.
4. To verify if any of the above actually apply to your situation or other options may be available to you, you should have an attorney review everything. Of course you need to have a sense of the value of the items on the punch-list to help you decide how much "good" money you may want to put into this situation.

We are going to have to take a paternity test to see if the child is mine but I am wondering how child support is going to be figured if I am indeed the father. I learned my 7 year old child does not have his own room or his own bed. I was lied to about this by his mother, and my son was coerced to lie to me about this, him being told by his mothers husband he would harm me if he told me. I learned my son has been sleeping in the same bed with his mother AND her husband for 5 years. I called DCF, and they don't see any problem with this sleeping arrangement, and told me it was a "communication problem" between myself and the other parties, and recommended "counseling". DCF refused my request for a copy of their investigation. I also have a voice mail recording of my son being threatened, screamed at, ordered to lie to me (its right there on the voice mail recording), told his father (me) would be harmed if he didn't lie to me, and harassed by his mothers husband. My son was terrified and called me for help, the husband did not know he was being recorded, it's several minutes of brutality, I called the police immediately when I heard the message. The DCF investigator, a college girl with no kids, thought the voice mail recording irrelevant . Should I continue to think maybe DCF will actually do something, or should I tell them to take their counseling and stuff it up their ass, and take these issues to court? You're damn right I'm angry, but keeping my cool and trying to do this the right way.

Although it is very large, Walmart is not a govrnment entity. If there is a governmentl entity that is denying you to own a gun, you might be able to sue them for violating your civil rights.

I have no way of knowing how or why this happened, however, if in fact there is an outstanding warrant, it is imperative that you either surrender and post bond (do NOT enter a plea); or the better option being to retain an attorney to investigate and find out the underlying status, and if valid, then handle it in a way where you do not have a record.

"Wishold" usually means Warrant Information Statement, Hold. I assume that you are referring to the codes at the inmate information center online. The Wishold is entered into the system when a suspect is arrested for one charge, and the Sheriff receives information that a warrant has been issued for that person on another matter. It usually occurs when the suspect has given an alias, and run of that suspect's fingerprints through AFIS or the California Department of Justice, and the person's true name and the fact that a warrant is outstanding is revealed.
When the Sheriff receives a Wishold, that means they will hold the suspect until he can be transferred to the other jurisdiction or authorities on whatever the warrant is for. So the suspect may have been cleared for the charge he was arrested, but will not be released because the Sheriff has received information that there is a warrant for him or her on another matter.

the bank can use whatever balance is in the accounts subject to any written account
rules set for the account. The facts are not clear regarding whether it was a joint
refund and whether the account(s) are joint accounts; however, the bank can take
whatever balance is there to offset an overdraft account. No court order is required
for a federal refund or other check since it appears that you or your husband
deposited the refund check into the account making it subject to bank rules. If
the facts of your situations are different, you may have another option to consider,

He has caused substantial damage for what little he did "fix" and left a lot of work to be done. I know that a contractor can place a Mechanic's Lien on a property until the contract is satisfied. Can a customer do the same to a contractor until the money is returned or it has went through civil court? I just want to make sure he does not sell his house/business and skip town before I have a chance to recover the money that is lost. We are looking at a sum of about $34,000.

In short, No. The Mechanic's Lien can only be filed against the property where work or materials were furnished. There are short time limits on that as well. The circumstances you've described would require the filing of a lawsuit against the contractor. Prior to that, you can attempt to collect yourself, or have an attorney do so. But given your concerns about time and the contractor potentially leaving the area, the best course of action is to proceed with the lawsuit to include actions to secure potential assets to satisfy a recovery. I'd be happy to discuss this in more detail.

If problems are found, it is the SELLER'S responsibility to fix those problems before the property can be transferred to the new owners. Does anyone know if Illinois has such a law in place? I am in the process of trying to buy a foreclosed farmhouse that is on septic. The bank knows nothing about any of the utilities and the house has been vacant for several years. A law like this sure would make things easier!

There is not a statewide requirement, but there may be local requirements. More relevant, perhaps, is that it is usually a matter covered in the contract and done so because the lender will require the inspection upon a determination that the property has a well or septic. A closing attorney familiar with local practice should be advising you and protecting your interests, including clear title.

My sewer line runs through my neighbor's property line. Since my house was built in 1919 and theirs in 1923, the city states that the property must have been subdivided back then, and the only main sewer line is in the alley next to their property. Recently when the city was installing new gas lines they determined that the sewer line was invaded by roots from two trees, one a mature citrus on their property located two feet from the sewer line and also from another tree located on the property of another neighbor, on the other side of my property. The sewer line located on their property would be best served to be replaced as the line is now comprised of clay piping. It is not damaged, just roots invading the pipe. I do not have an easement on my title. Several questions: We have been told that this is a civil matter and needs to be rectified by all parties involved based on what caused the damage and how we would like to solve the issue. They claim it is my sole responsibility to fix it at my expense as it is my sewer line. Also what happens if there is a problem in the future? Even if they again damage the line, am I responsible for the cost of fixing it? And lastly, without an easement, how does this impact me in the future or at resale? Thanks for your help.

I am not married but a have a child with my boyfriend. If I want to move to another state (where my parents live) and take my child, do I need to file any specific paperwork informing my childs father, because I am taking my child out of state?

I'm assuming that there is presently no court order in which your boyfriend admits he is the child's father, in which case he would have been ordered to pay child support. If that is the case, you are free to move anywhere. If he objects, he would have to go to court, admit paternity, agree to pay support, and resolve issues regarding custody and visitation. Or if you would like him to be under a child support order, which could be enforced by having the payments taken from his paycheck if he gets one, you could do this.
