Of course it's blackmail/extortion. You are basically attempting to limit the options to the one you want by threat of being a dirty snitch. The fact that you are possibly justified doesn't change things. I should also point out that your plan could backfire because if you go to report this to the police, if you are not careful in your story you could be charged with possession of stolen goods.

Now 10 months, 14,000 miles later we brought the truck into my local Cadillac dealer to have some warranty work done. They say the factory warranty has expired but i told them that the truck was certified and i had 23,000 or 2 years to go. They said it have not been entered from the dealer i bought it from. So i called the original dealer and asked them to check it out. They called me back an hour later to tell me that they never certified it and forgot to take out the certification card which is signed by the dealer. Also the 172 point check was never done. No suprise that they offered my $1200 to make up for their mistake. I told them that the problem i am having the truck will cost me $1200 plus to fix, the i have to hope nothing goes wrong in the next 2 years or 23,000 miles. The insisted on talking to my son so they could perswade him into the cash and let them off the hook, i told them they have to deal with me instead. The Escalade new window sticker was over $87,000 and we paid $50,000. The labor and parts cost are very expensive that why we bought it with that longer warranty. Once the rights are terminated, there will be no obligation to pay future child support. Yes, you can take the case to Small Claims Court but is it worth your time and trouble??? You will have to sue the person who hit you and not the insurance company. You will have to spend the money to pay the court fee and then the money to serve the person with the complaint. If there is prior damage then the judge might try to apportion the damage or award you nothing. I doubt this is worth it.

We finally called the officers to file a report. When they arrived they decided to go enter the premises and fetch her out. She lied to the new set of officers by saying she was returned it 2 months ago, and now they are suing us. We never entered the premises per the officers rules. There were no confrontation by any of us. We waited in our vehicle until the officers showed up.

Do they have a case against us? If so, would this be considered civil or another kind of lawsuit? I'm trying to find out if they can actually sue us for hundred's of thousands as they said they would; I am still awaiting being served the so-called papers.

In Ohio, there isn't much difference between divorce, disolution and legal separation as far as cost go. The key to keeping costs down is keeping the fighting over issues to a minimum. Because dissolutions usually involve a separation agreement worked out to everyone's satisfaction, that can keep costs down, but paying the attorneys to get everyone to a deal is sometimes not cheap.

Bottom line, if you aren't fighting over anything, the termination of your marriage isn't going to cost you too much. If you are fighting, the sky is the limit.

Second, more than one person can commit a theft or be in possession of stolen property. As long as your parents agree to "give" you the money and you do not lie about it to the lender, it appears that you would not be violating any criminal laws by using such a gift to make down payment on a house or condo. If you decieve the lender or any governmental agency involved with the loan, you may have civil liability and possibly criminal culpability.

Urine tests need to be done by a court approved lab. I have never heard of a urine test being admitted into evidence without a trained professional doing the test and collection.

Anyway, I would like to give it a second chance, in hopes of more information.

In 2008 I worked for a small Printing Company. I ran a very large digital press and also handled some design and file preparation, working anywhere from 40-60 hours per week. My partner worked there as well as Office Manager, and worked the same hours as we drove in together. The office was fairly small, including the owner, his partner, a design and color expert, accountant, and a gentleman in bindery.

Everything went smoothly for over half a year. Sometime during the 6th or 7th month I came across an odd e-mail. One of my job's (and everyone else's jobs, for that matter) was to check each e-mail on a constant basis. That means I had access to EVERY PERSON'S e-mail in the office. This was to make sure that no one forgot anything, and nothing fell through the cracks. One day when I was doing this I came across a strange e-mail -- as I said -- from a person I did not know. I did my research, trying to see if she was a client or otherwise, and a simple Google search showed that she was a prostitute. At this time I said nothing.

Several more e-mails came through from her over the following month. They talked about having sex multiple times, having a threesome with one of her friends, falling in love, and the gift of a GPS-Unit. Around this time my Boss hired two new people - a gentleman I was training on the machine as well as on pre-press, and another office girl - and he was about to go on a trip with CANON because the machine I ran was having continual problems. Being a quarter-of-a-million dollar machine, CANON was anxious to figure out hte problems so that they could continue manufacture, as this was supposed to be a machine that could handle the stress of a busy press.

Anyway, my boss's wife could not come with him on the CANON trip, nor could his partner. Instead he took the prostitute.

While he was gone my partner and I were discussing the goings-on of the office. I knew from the accountant that the man I was training was making more money than I was by quite a bit. My partner was also training the girl, who was getting preferential treatment because her mother had been an old crush of our boss's, and.. well, let's just say she was rather attractive.

I finally decided to approach our boss's partner asking for a raise, not wanting to stress our boss -- who I considered a friend -- during his vacation. During this process, I let the partner know that I was seeing e-mails that I would rather not see, that were of personal nature. I was trying to warn him so that this could be fixed.

Instead what happened was the Accountant learned all of this information and told our Boss before he got back. When he did, we were confronted and I explained that we had approached his partner because we did not want to stress him out wwhile he was having a good time... and that I had mentioned the e-mails hoping that his partner could warn him that personal information was coming through.

It was then that I found that that e-mail account was NOT supposed to be showing up on my computer, and that it was a personal account, of which I had NO idea.

Needless to say, things got very... tense after this. About a week and a half later we were approached by the partner who gave us our options: We could agree to sign a piece of paper stating that we would never tell anyone about our boss's transgressions and we would receive severance, and they would not fight us when we asked for unemployment. He also promised us good recommendations for future work. I told him that we would be happy to sign the piece of paper and continue to work for them, as we had no intentions of spreading the rumor (though we found out that everyone in the office knew anyway... since the e-mails were pretty obvious). Our boss denied this.

We had no option but to sign the paper, which we were never given a copy of. We received our severance and everything promised (though they weren't very good about the good recommendations). This was at the end of 2008, in October. We were then forced to move 'back home' because we couldn't afford to live where we were anymore.

Anyway, about two years later I was talking to someone about it, and he told me that it was all very, very illegal. He told us the paperwork was illegal, and that not receving a copy of our own was illegal. I believe he called it all extortion. So at this time we tried to find legal aid. We called various lawyers, went through Better Busness Bureau, etc., but could find no help. I've given up on suing.

Now, three years later there is only one thing I want to do. I want to tell his wife what happened. After all this time, I realize the only reason I didn't tell her was because I was hanging onto the idea that I had once been friends with our bosses, and that she had a young son. However, I don't think this is fair any longer. She was having marital problems with him when we were working there (other e-mails were seen coming through from her, that were pretty ugly between them, and basically showed that they were staying together for the son). She owns half the business, though she has nothing to do with it, because they got tax breaks by having a female own part of the business (this is only one of the shady practices they used, including buying items on Craig's List and not claiming them for taxes, claiming random items as business expenses, etc).

In short, I want to send her a well-worded letter letting her know what happened. I have e-mail proof of the transactions. THere was also the trip with CANON that could be traced. My partner is afraid that we will be sued for Libel, but I can't see how they would ever win like that. I do not plan to send a letter to anyone other than his wife, and she can make up her mind what to do with it form there. I am not asking anyone for money.

I want to know if this is safe to do. I do not want any help with ethics, as it is not the problem. I need to know what my options are PURELY from a legal stand-point. There are a host of privacy issues going on here. Even with access to the emails, you were only supposed to have access to "business" emails and once you saw that they did not have anything to do with the "business", you really don't any reason to have access it and it would be an invasion of privacy, as you said it was a personal email account. I am also troubled with your statement that you went to Google and it "showed she was a prostitute". Google does not classify, categorize or identify people as prostitutes. You will be stepping in hot water from her if you call her that. Bottom line, don't write any letter to anyone. It won't do any good and can bite you VERY hard when every one sues you. Slander, Libel, intentional infliction of emotional distress, invasion of privacy, false light and negligence are but a few I can think of that will go against you.

I would need more facts to answer your question, but you should know that PA is a very pro-employer state, and unless the employer violates the laws of the Department of Labor and Industry; discriminates against you based on race, sex, age, or physical condition, or if you get hurt at work. Absent these circumstances, you are probably subject to termination for just about any reason that the employer wants. The reasons you can sue an employer in PA are very limited. I would need to know how your employer has caused you "undue financial hardship" before I could answer the question.

It probably says to file an answer to the Petition. It means that you musy either file a written answer (and send copy to the plaintiff attorney) or appear at the Answer docket. Otherwise the Plaintiff may get a judgement by default against you. You may want to consult directly with a civil practice attorney in your area. In December of 2003, he Quit Claimed a house that he owned (with approx $50k of equity in it) to me because he could not afford the mortgage payments. I did not pay him any money for the equity. I subsequently refinanced the house in my name and have been making payments on the mortgage for the last 10 years.

1. Can my brother's Abstract of Judgement (recorded in December 2008) create a lien on my house (which was quit claimed to me in December 2003)?

Is the Judgment recorded as a lien against your house?

Since he quit claimed it to you 5 years prior to the abstract, the transfer is probably safe from a fraudulent transfer claim. The house is now in your name only? If yes, any judgment against your brother will not affect you.

If the Judgment is filed against your house as a lien, you need to contact the creditor and ask them to remove the lien. If they refuse, you can sue them for "quiet title" and receive damages, attorneys fees and costs.

1, No. You owed the property well before the judgment and the abstract can only create a lien against property in the name of the judgment debtor. If there hand been a lien against your home, you would not have been able to refinance the property.

2. No. If someone gives away an asset for free or next to nothing to hide it from creditors, a creditor could theoretically file a lawsuit to get in back for the judgment debtor and then put a lien on it. But even if the creditors had a valid claim, which I don't think they do, the statute of limitations would have expired long ago.

The bottom line is that I believe you are clear and the title insurance you obtained should protect you.

Without access to all the details of your sweat equity arrangement and without knowing whether the sublease goes beyond a sublease in its terms, I can't be entirely sure. However, in most cases, a sublease of business property wouldn't cause a termination of a pre-existing sweat equity agreement. Obviously, however, there could be an impact -- positive or negative -- on the ultimate market value of X% of equity from such a sublease (just as there could be an impact on the value of equity from any other major business event or transaction). As to starting your own business, unless there was some provision in your sweat-equity agreement that you had to stay with the company for some definite period in order for your sweat equity to vest (i.e., become yours), you shouldn't lose what you've already earned. However, if you aren't around to observe and participate in the business, funny things can happen. As far as the legality of going into competition with your previous employer, California favors competition and it is generally legal to jump ship and start your own business, but don't steal any of your employer's trade secrets.

It appears that both the school and church may be liable (as well as the person who was in charge of him that night) to your brother or his guardian/conservator. Obviously, whoever approved him getting treated, is liable to the healthcare provider. The churches liability is not limited by their insurance coverage (they just get part if it paid by their insurer). I suspect that the church has contractually agreed you recompense the school district for any claims made by those who attend services. That is between them, and doesn't really affect your brother.

Normally you can expect many answers..and of course you need a lawyer. But the friends setlement only affects your settlement to the amount they accepted. For instance, if the insurance limits for the at fault driver is $50,000...then you may only have tat much left. From the description you give, fortunately nothing serious but u all have two years from the date of accident to file a lawsuit.....apparently you have healt insurance so no rush there. And I presume you have underinsured coverage which needs to be considere..and your policy may provide Personal injury protection, unless you rejected it, for all occupants..

I'm sorry you and your family were hurt in this wreck. I will try to address each of your questions below:

Actually, your friends accepting a low settlement offer could wind up being to your benefit. All liability policies have a limit to what they will pay, no matter how many victims or how severe the injuries. If the aggregate limits of the policy of the guy who hit you is $60,000 and your friends settle for $3,000, then that leaves $57,000 of policy coverage to compensate you and your family for your claims. The more the insurance company pays your friends, the less there is for you and your family.

2. If my friends settlement can impact my settlement, what should i advise them to do? I know it may seem mercenary, but you need to decide what is best for your family. I would be honest with them and can tell them what was discussed in answer to question 1, but it is there decision, and if they are happy with $1,500 each, then I see no reason why you should try to convince them otherwise.

3. Based on the financial details above what is the amount that I can expect to get for pain and suffering if I try negotiating it my self? That is a very difficult question, and requires a crystal ball to answer. That are a lot of things that could effect the value of your case from the amount of property damage (a good fact for you) to the insurance company involved, to the adjuster assigned to your claim. What you need to understand is that insurance companies are not in the business of compensating accident victims, a common misconception. Insurance companies are in the business of taking peoples' premiums and never giving them back, that's how they make money. So, the insurance company will try to get away with paying you as little as possible. You should know, however, that a study by, I think it was the insurance institute showed that people represented by attorneys received more money than those representing themselves, even after deducting the attorney's fees. Also, the great thing about using an attorney for your situation is that it does not cost you anything out of pocket. The attorney is paid out of the money he gets for you and your family.

Also, 20 years ago the rule was they would pay three times your medicals, that is not true anymore. 5. When is the best time to engage a lawyer? The best time is to hire a lawyer right away. The adjuster has probably already taken your recorded statement. You may have innocently said something in your recorded statement that will be used by the insurance company to discount your claim. Or you may have gotten frustrated with the adjuster and things have gotten adversarial. If that is happened, the adjuster may jerk you around out of spite. Obviously (and thankfully) this is the first major wreck you've been in. The insurance adjuster has dealt with thousands of these claims. The adjuster has the advantage and the check book. What I tell my clients is that they're David, the insurance company is Goliath, but I'm their sling shot.

6. If i go it my own when is the best time to settle? Should I wait for the medical issues to be resolved? Absolutely. You were involved in a VERY serious wreck. Once you sign the settlement release, there is no going back for additional monies and the insurance company will not settle with you and leave the door open for you to get additional medical treatment. You should be sure that the doctor has discovered and treated everything that was caused by the wreck, that you have had all the diagnostic tests needed to determine everything that's wrong with you, and that you know how these injuries will effect you in the future, such as arthritis and the potential for a future surgery. Do not settle until you know the answer to these questions.

7. Is there anything else i should be aware of that I missed or may not know? Yes, but I don't want to overwhelm you. You need to check to see if you have Underinsured motorist (U/M) coverage on your auto policy. The value of you, your wife and child's claims may be more than what is left on the policy of the guy who hit you (see answer to question 1). As such, you should open a claim under your U/M policy. And, this is extremely important, make sure you get written permission from your U/M adjuster to accept a settlement from the insurance company of the guy who causes the wreck. Otherwise, you will have waived your ability to recover under the U/M policy. Further, if you haven't started treatment for your injuries, you need to do so immediately, as you are playing into the hands of the insurance company. They won't pay you for treatment that you might have had or should have had. Further, they will argue that, as you didn't get treatment, you must not have been hurt. Again, they are looking for anyway to not pay you what your claim is worth.

First, I would need to see your credit report. I don't understandd why the debt was removed from your credit report unless the debt was stale (waws older than 7 years since the date of charge-off or first sent for collection). If you paid, your report would ordinarily be amended to state that the debt was paid in full or settled.

When you paid the debt, did you get a settlement letter indicating that payment of the settlement amount would end any further collection efforts? Did you keep a copy of the settlement letter and check or money order?

If not, then you may have to pay again since you have no proof of payment. Just telling a collector that you paid is not good enough. Most collectors that I deal with want to see proof of payment.

What do you mean by the collector "froze" it on your credit report? Debt collectors do not freeze credit reports. Freezing refers to something else - it is something that you do.

Assuming that you settled the debt back in February, nothing precludes the balance of the debt from being re-sold to another collector.

There is no time limit for validating a debt. The Fair Credit Reporting Act says that if a debt is not validated, then it is supposed to be removed from your credit report completely. But that is something that you dispute with the credit bureaus. The validation under the Fair Debt Collection Practices Act is different. Under the latter, you dispute your liability for the debt with the debt collector. Upon receipt of your letter, the debt collector then asks the creditor or current owner of the debt for validation and proof that you owe the debt. While the debt is being validated, it should not be on your credit report at all.

It is unclear what your nexty step should be. As I stated, your credit report should list the debt but that its been paid (in most instances). If you protected yourself properly by getting the settlement letter and making a copy of your proof of payment, the first step upon receipt of the letter from the second collection agency would have been to dispute the debt on the grounds that you already paid. That would have ended the matter in most cases.

Since that was not done, you indicate that the collector requested validation of the debt. How do you know? Are you relying on a phone conversation? Or did you do a dispute letter?

I would send a written request to the 3 major credit bureaus (after you confirm how they are reporting the debt) and ask them either to remove the debt (if its stale) or to correct the report to reflect that the debt has been paid.

Only unpaid debts have negative consequences, not paid/settled debts. Assuming that the debt is validated by the 3 credit bureaus in 30 days, then you need to send a certified letter to the debt collector or creditor who placed this information on your credit report and ask them to remove the item. If the second request is refused, then you can bring suit against the entity that placed information that is erroneous on your report. You can recover up to $1000 or your actual damages. If you get that far, contact local counsel who specializes in FDCPA/FCRA violations. You might try Attorney Greg Artim as he is in your neck of the the woods- he has been active in the past at Law Guru. Or you are free to consult with any other local attorney.

Today I received a decline notice from a lender with whom I had applied, that was based solely on a Courtlink printout provided to them by Comergence. The individual simply shared my first and last name and had a pending Federal criminal case against him for drug sales in a county located 7 hours from my location. This is not me and I called Comergence and was told that I would have to drive 7 hours to the US Court in order to have them provide me with documentation to show that the inidividual is not me. I am not going to drive 7 hours for a job that they needed to provide for a service that they charged me for. They didn't use my social security number, address or anything else related to me. I asked to speak to a Manager and after 10 minutes on hold their representative told me that there wasn't a Manager available but they would call me back. They did not which added to me being livid. They were negligent for breaching their duty of care in providing the lender with carefully obtained information. I would like to report them to the AG and Dept. of Consumer Affairs and possibly the County DA in which they conduct business. I would like your feedback on my remedies available at law.

There is no avenue by which you can appeal the decision on how to charge someone. You could talk with the prosecutor actually handling the case about why it is that the person was charged manslaughter and not a greater offense. The prosecutor might be able to explain the law and why a higher charge would not fit the facts. If you are not satisfied, you could ask the prosecutor about presenting to the grand jury in an effort to obtain an indictment for a higher crime. If you choose this avenue, you should probably hire a lawyer to help you put the packet together. Otherwise, it is the DA's office's decision on the charge.

(I have worked in Harris County 23 years. I find that they more often over charge cases, not under charge. My guess is that there is some nuance in the law as applied to the facts that you are not understanding. Update we have sent the letter required to demand repayment of the NSF check on the Fidelity Trust account that the half sister cleaned out before the aunt death, the aunt had 650k in this trust in May 2011 wrote us a check for 60K to pay off our home she wrote this in the memo on the check as well, she wrote the check to us 7-16 she passed away 8-2 but we did not get notification it was NSF until 7-21 by then the aunt was in the hospital and on morphine so we are trying to make the heir make good on this check, we will file a report with police after the 15 days so they can send to State attorneys office but I really feel like we will end up in court with her and the paperwork we filled out stated if we go to court & win the case will be for 3 times the check amount so that is 180K ( we are not trying to get that we really just wanted what aunt Martha wanted us to have) we live in Lakeland Florida any lawyers close to me interested in this case, we have the NSF signed by aunt, we have another family member as a witness she wanted us to have a check for this

If she cleaned out the account, Fidelity Trust has no funds with which to pay you. You will have to go after her personally. If she has no funds left or spent off the assets you can obtain a judgment and fraud - perhaps jail time for the aunt but you still have no money. I suggest you hire a probate litigation attorney and hope that he can obtain the assets that are left before they are gone.
