Possibly, but most generally an agreement to sell a business does not include the right to take back the business if the buyer defaults on payments. Most likely, you have a claim for money damages, and that's it. However, it's not impossible that your sale agreement also contained some kind of collateral support for the buyer's promise to pay. This could be in the form of a lien, security agreement, etc. on the personal property and, if the sold business included real property, maybe there was a deed of trust securing the purchaser's obligation. It sounds as though the business owned real property, since you are talking about taking back possession and locking the buyer out. (You mustn't do that, by the way).

The threat of bankruptcy should be taken seriously. It can happen almost instantly, and when it does, the buyer and the business will be under the jurisdiction of the bankruptcy court. You will be in a line with the other creditors, trying to figure out the priority of your claim and the likelihood that you'll recover 99c on the dollar, or 5c, or nada.

Right now, you should review the quality of your business-sale documentation, and hope the lawyer who drafted it for you has left you in the position of a well-secured creditor

The schedules will also tell what the husbands intentions are: He must reaffirm, or redeem, the debt, or surrender the car to the creditor. If he reaffirms and pays in the plan, no problem. If he redeems (pays the fair value) in the plan, no problem. If he surrenders, then the debt must be paid by the wife to prevent repossession and sale of the car with loss of the wife's equity. The divorce proceedings are not stayed and the wife could cause the divorce court to make some award that is in the nature of alimony or child support to protect the car. Normally the issues are larger in a divorce case. The wife's interest is not an asset of the estate and remains vested in her. Note: From a creditor's standpoint the amount paid by the wife is applied to the entire balance and the remaining balance is a joint debt, meaning the creditor can collect some or all from either debtor, except that it cannot collect from the husband because of the bankruptcy. I do not know what kind insurance would pay more than 1/2 of the balance to the creditor on behalf of the wife, but some factual circumstance may give rise to an equitable argument, that is, that it is not fair to let the husband discharge his debt and require the wife to pay the remaining balance of the debt on the car to keep it. If she does not prevail in such argument, then, if she pays it off, she should be awarded the car. The direct answer to the first question is yes. If the wife signed on the note, she is liable to the creditor. If she pays off the full amount without prior arrangement or agreement, she and husband each own a 1/2 interest in a car free and clear, that is, she made a gift of 1/2 of the payment to husband. Thus, full ownership must be resolved prior to the wife paying off the car. If no agreement can be made, the divorce court will impose a settlement regarding the car. At least the automatic stay prevents repossession of the car during the bankruptcy as long as the creditor doesn't demand a stay modification to allow repossession and sale. If the creditor does, the wife could show up in bankruptcy court and propose to make "adequate protection" payments to the creditor and be protected in those payments with credit to her interest in the car or refund of payments if the car is ultimately sold by the creditor or husband or eventual trustee in a Chapter 7 case. I am currently on felony probation for a conviction of Aggravated Battery on a House Hold Member and false imprisonment. I was placed on 4 1/2 yrs probation. I have 21 months left of probation. I am 44 yrs old and have never had any other convictions misdemeanor or felony prior to this conviction. My question is this: Is there anyway to get off probation early. Can I request to be released from probation with an unsatisfactory discharge? Can I possibly get a reconsideration hearing? I am not a habitual offender. This sentence is preventing me from furthering my career in Municipal Goverment. I am unable to go to school or training out of state.

An early discharge from probation is possible, depending upon your prior record while on probation, and your relationship with your PO. If it is a good one, your PO's recommendation is the best and easiest way. Usually if the PO is against it, early discharge is really uphill. It is also possible to petition the court for early discharge without the recommendation of the PO, but the reason for the request would have to be more compelling than the reasons you state. Bottom line, unless you have a near perfect record while on probation and the recommendation of your PO, your chances are pretty slim.

Upon moving in, the house was not clean, many closets, cabinets, areas stll had property from the previous owner/tenant. I wrote a detailed letter to the owners, expressing my problems and requesting that they make specifics repairs within 30 days. One was there was no dead bolt locks on the front entry door, both back sliding doors wouldn't lock and could be lifted on the track for easy entry into the housing. The house wasn't clean, sanitary. They said they were remodeling, but only changed the flooring. Ceiling Fans with shorts, grass not mowed, a truck load of old carpeting, boxes, furniture left in the driveway and garage. The landlord obviously did not deliver what he was obligated to do. You were entitled to the lease being voided. Since you had given up your prior rental, you cold not go back to it so it was not unreasonable that you stayed in the new place. At a minimum you are entitled to

1. your entire security deposit back and any other money you paid as the landlord breached the contract before you moved there;

2. the reasonable cost of moving since you would not have moved from your former location, which includes reimbursement for the time you spent boxing and preparing you items to be moved, time spent arranging for the move, any new utility charges;

3. for a reasonable time, say a year, the difference in rent between your old unit and the new one you find [if you were going to leave] or any increased costs if you go back to the old unit;

4. all the rent month you paid the new landlord as he knew the place could not yet be moved into and the difference in your old rent and what it costs or reasonably should cost you to stay temporarily

I moved into my cottage on a 11 month lease September 2012 , utilities were included in the rent (internet, water, gas and electricity). Rent ($1400)has been paid on time every time and never withheld. In the Craigslist ad there was a picture of the property. It was clean and in immaculate condition. When I viewed the property there was garbage and debris everywhere on the outside of the unit. The landlord assured me that it would be cleaned up. We signed the lease. That same month I was without water for 4 days. The landlord was in a feud with the tenant in the main house my cottage is attached to and decided not to fill the water tanks that supply domestic water to the main house and the cottage. October rolls around I asked once again to have the debris and garbage removed and was given the run around. Garbage was not removed until mid-January. During the end of January the propane tank ran out therefore I had no hot water for over a week. I also just found out through my research that there is supposed to be a working heater/furnace in the cottage. The unit has no heater/furnace. When I mentioned these problems to the landlord in an e-mail his response was that I had 30 days to vacate. Do I have any recourse?

You may have some cause for habitability issues... He may be constructively evicting you based on his actions. If you are having so many issues you may not want to live there.

If the goal is to avoid a criminal conviction record, the best outcomes, in order would be: 1) dismissal now; 2) a continuance for dismissal 6 or 12 months from now; 3) a stay of adjudication; or 4) prosecutor "certifies" or amends the charge to a petty misdemeanor. A "hearing officer" is generally not a judge, nor a prosecutor - but a court administrator with written guidelines from local prosecutors. They have no dsicretion. If they offer a continuance for dismissal, I would consider accepting. Otherwise, I would request a court date. If it's important, retain a defense lawyer. That will help.

I am not sure what exactly you are asking here. After a car is repossessed, most debtors have 10 days to redeem the vehicle. In other words, they can get the car back if they have paid. Most lenders will not allow the debtor to just pay the amount by which the car is behind - they want the whole amount due. As a practical matter, if the debtors had a problem paying the monthly payments then few debtors will be able to get the whole amount owed. However, the debtor has other remedies, like bankruptcy, if they want to get the car back.

If the car is not redemeed, it is then sold at an auto auction. Anyone can bid at the auction. If the car is sold for less than what is still owed (plus the repossession and sale costs) then the lender asks the debtor to pay the deficiency. The deficiency then becomes like any other unsecured debt. In the rare case, if the car would be sold for more than what is owed, the lender would return any excess funds to the debtor. I have never heard of a case where this has happened.

If you are a savvy buyer, find out when auctions will be held in or near your area (they may be out of state) and bid at the sale.
