Hello, I had a general question about health insurance coverage and divorce. If I am divorced and carrying insurance on my three children from my previous mariage, get married again and drop my insurance becuase my spouses is better, how does that affect child support? Being that one of the exclusions is healthcare premiums, how is the calculation produced since I am not paying the premium anymore, my spouse will be, but we will be married so it is implied that I am right? Or, since I am not paying for it anymore, the amount goes up since there is one less exclusion, and since the law states that I have to have health insurance on them, it really doesnt matter right? I live in Illinois...



Answer

I believe your spouse paying is still an appropriate deduction. I doubt that a de minimus change in the cost will cause a change in the support.
