Question

I was recently given a ticket and an order to appear in court because minors were found drinking in my home. I have court next week. I have no criminal history and I'm in the state of California. I'm really worried about going to jail. What should I do? What are the odds of me going to jail. I'm a married mom with 3 kids.

Answer

You haven't provided enough information to assess your chances. You should discuss your situation in detail with a lawyer.

Good luck.

Answer

If you have no prior convictions, then your attorney should be able to keep you from serving any time. Assuming that you do not really have strong legal defenses to justify taking it to trial and attempting a 'not guilty' verdict, and not ignoring the substantial fees and costs to do that, the proper outcome your attorney should be seeking is a plea bargain that avoids jail, and minimizes the fines and other penalties you face. If you have not yet heard from Child Protective Services about legal action they could take regarding custody of your children, you should breath a sigh of relief, for now.

If you can't find local counsel, and are serious about hiring counsel to represent you in this, feel free to contact me.

Answer

There's more to your story than you provide here, and I would advise you not to say more. You need to get an attorney. If you cannot afford an attorney, you need to ask the court to appoint one for you.
