I am a tenant in massachusetts and I am terminating my lease early. I put this in writing for the landlord and they have already found someone and they have signed a new lease for when I move out. The landlord is demanding an early termination fee (for using brokers to find a new tenant etc.) however there is nothing in my lease that makes note of an early termination fee. I told them this but they said even though it's not in the lease their attorneys said it is still owed. Is this true or are they just trying to scare me thinking I don't know my rights? Do I legally owe them an early termination fee?

Not neccessarily - but if you are terminating your lease early, they could potentially collect the rent they would have received from you if you stayed for the entire lease period.

Since landlord has another tenant moving in, that amount that they can try and recoup from you is probably much less (if anything at all).

The simple answer is whatever the lease says you own is what you owe. If there's no early termination fee than you're not bound to pay it.

I would contact an attorney who handles personal injury law. You have what is called a products liability claim- a claim for when a product is defective or harmful. Unfortunately, you will need to show damaged (how you were harmed) to recover anything from the company.

I would guess that most if not all personal injury attorneys would decline to take the case unless you coudl show that you had medical bills or other financial harm due to the hair. You may be well served by calling the company and telling them what you found. Many times the company will compensate you to avoid the publicity. Make sure you keep the cheese stick, the hair, and the packaging sot hat they can track where it was packed and perhaps who did it to find the problem.

There is a lot of fraud in this area of law, so make sure you keep documentation and hopefull you have the items I just listed above.

Just before the hearing, they filed a Dismissal without Prejudice. I filed a Memorandum of Cost with the court. They mailed me a Motion to Tax but never filed it with the court even though they reserved a date and time for the motion. It has now been 21 days since I served them the Memorandum of Cost and I filed a Proposed Order Awarding Cost with the Court.

My question is this: Am I missing something here? Was mailing me a copy of their Motion to Tax sufficient for the hearing or were they required to file a copy with the Court within the 20 days of my service of the Memorandum of Cost (served by US Mail so 15 days + 5). Any help is greatly appreciated.

They should have filed the motion at least 16 court days prior to the hearing. The court can't rule on a motion that has not been filed. But be careful, if you are relying on the online index or the file in the clerk's office to make the assumption that the motion has not been filed. Many times when a motion is filed, it is sent to a law and motion clerk who drafts a memorandum to the judge who will decide the motion. The motion will often not be filed or indexed in the computer until after the motion has been decided. So your best bet is to assume it was timely filed and prepare a timely opposition and attend the hearing.

He brought his girlfriend to live with him, they argue all the time, and they want us to pay for all the utilities; we stopped doing it, and now they are threatening us that they will call immigration, and they will call the cops, we do not know what to do. YOu need to speak with an elder law attorney. If your husband is a VET - you can place him in a veterans home and they will only use the VA benefit. You will keep the SS and other income to run the household.

If your husband needs to go into a nursing home, and you do not have the resources to pay it, then when you apply for Medicaid, you can request a spousal allotment, so a portion of your husband's income can be redirected to you. Right now, the spousal allotment is $1967 per month. They will deduct the gross amount of your income (your income before they take any insurance premiums, medicare, taxes, prescription drug plan premiums out). So if your income is $800, and you pay 104.90 for Medicare, then you would be entitled to up to $1062.10 from his income ($1967-904.90) each month. In addition, you may keep the home and car and at least $25,000.00 of your savings, or 1/2 of your savings if it is above $50,000.00.

If your husband is a veteran, then he would also have other options, he should apply for Aid and Attendance, or may apply for entrance into a Veterans home as another attorney mentioned as well. The cost is very little compared to a nursing home.

in 2003 i was a tourist in Florida and had treatment in the emergency room and . I paid 4000 Dollar in cash. At that time, i was told this is the amount to be paid. I also asked for the medical records and the hospital failed to give them to me for several months. I was told, that they got lost. I had to fly back to the use, in order to get them a year later.

End of 2003 i received an invoice of 18 000 Dollar (!!) and i wrote them back, that i would question the amount and the service for it. I told them to get back to my insurance. In 2004 i had a letter from a collection company and i wrote again back, that i paid and the other amount i questioned it. I did not hear from them until 2012 when i got a letter from a collection company from Europe now. The amount is now much less and every time they write to me this amount various (gets less).Under german law the limitation of service for medical bills are 3 years, i guess in Florida there is a limitation as well, 4 or 5 years depending if its seen as a written contract or oral, right?

After the company did not get any reaction from my side, they wrote me yesterday, that the limitation of service stops if you leave the State of Florida but i was never a resident of Florida and i gave the hospital my proper address in Germany.What is the statute of limitation is this case, it has been now 10,5 years. My biggest concern is, that the limitation of service stopped when i left Florida, is this correct? Would they still have a chance to sue me in Florida? They would need to have a title anyway but i guess this title would be useless to enforce in Germany as it is expired here. But is it expired in Florida? Would i have problems to enter the state?

I wonder, why they never sued me, if its not expired in Florida.

I enrolled in a LVN-BSN bridge program 2 years ago. At the time, they were accredited in California. However, this past year, they are no longer accredited in California due to losing their contract in a California based university as well as having no clinical sites. I've tried since April to get out of the program, but with each representative that I speak with, they disregard my request to drop the program and continue to encourage me to "continue the program". Though they have no accreditation, they now have clinical sites that are located in Sacramento and Long Beach, but I reside in San Diego. I was assured when I first enrolled that San Diego sites would be plenty to do my clinical portions.

Is there any way I can get out of this? I would like to get my money back or if not, at least stop paying in which will not affect my credit score.

While you can certainly sue them for your $25,000, what you should have done was obtained legal advice up front before you invested. Your question does not contain enough information for me to be able to say whether they would be able to discharge the debt in a bankruptcy. If you had a contract drafted, you could have had the contract say that they would have to pay your attorney fees to collect the debt. In all probability you will have to pay your own attorney fees, so even if you collect $25,000 you won't be made whole. Watch out for legal time limits.

You are in what's normally called a "holdover" period. Maybe the landlord has nobody else who wants the space right now. Maybe the landlord is just thankful you're still there. It's impossible to say, but an attorney should review your lease. Why? Because if it's a "standard" office lease, then the holdover rent may be MORE (like maybe even double? - some say "1/15th the rent as a daily rate" or "200%" of the last rent....) and your landlord may still have some time to decide, and then you may get hit with a back rent charge of sorts. Or they'll lay low and if someone comes along who is willing to pay more, then they may just try to evict you if you don't agree to a substantially higher rate. Some folks hire a broker in situations like yours; you may just want to talk to one too, just to see whether the deal you were offered is a good deal, or maybe with some sweeteners it could be (repainting, recarpeting, etc...). But definitely have an attorney review the lease for booby-traps.

In the case of a partnership that has incorporated and incurred debt after incorporating, but the creditors still reasonably believed they were extending credit to the partnership (and hence that the partners stood behind the indebtedness), the situation may be governed by Corporations Code section 1158(e). I would advise looking up 1158(e) (on line?) and reading it carefully to see whether it fits your situation.

Also note Corporation Code section 1158(f) which describes how the 90-day liability period can be eliminated by giving notice to the creditors.

You should hire an attorney to make sure the appropriate paperwork is completed and filed properly; there are additional documents you need to file to ensure that the taxes are transferred. As legal expenses go, the cost would be nominal.

Obviously Mr. Stone didn't read your question carefully at all. The correct answer to your question is, "maybe, but probably not." First, you must have taken all reasonable steps to prevent him sending you the messages after the first one. Unless you blocked his email address and marked messages from him as spam, and took all other steps available to you with both your email service company and his, you don't have a case. Then, even if you did that and he illegally circumvented the blockade, you must have suffered actual damages from his conduct that can support an award of money damages.

The only other possibility is that his messages rose to the level of criminal conduct. You'll have to check with the police about that.

First, no contract is required to form a partnership - in the absence of a written contract, an oral agreement will do; and in the absence of an oral agreement, it is sufficient that the persons involved in the business merely do the things partners ordinarily do. In your case, the absence of a contract won't prevent a court from finding that a partnership exists, and applying, where necessary, the default provisions of the California Revised Uniform Partnership Act to determine what the partners' rights and duties are. They are substantial. See the RUPA in the Corporations Code, at sections 16100 et seq.

Next, your specific rights would depend to some extent on what you want. I'd suppose you'd rather (A) receive 50% of the value of the business, rather than the alternatives of (B) having your investment returned, or (C) being reinstated as a partner with full rights under court order -- but you do have a choice to make.

However, you probably aren't going to get anywhere without taking legal action. I'd advise filing and serving a lawsuit asking for an accounting and for judicial dissolution of the partnership, under which you'd presumably get (A), above. In practice, after being sued, your partner would likely negotiate with you rather than defend, making it unnecessary to pursue the suit to trial and judgment.

You initially said you filed for divorce in 11/05. If you filed for divorce then, then if it was a property settlement agreement you signed then you could have completed the divorce at that time. The one year is from the date of filing if it were in fact a separation agreement. If all of the terms were complied with then the separation agreement should be converted. Unless she has proof that there was not full compliance then the divorce can be contested.

The answer to your question is highly dependent on the trust terms, and many other factors. For example, if the trust contains a spendthrift clause, you may not be able to vary the trust terms. The tax basis of the property and the interests therein depend on datae of death values. If you are able to enter into a transaction such as you describe ( which is a big "if"), the tax results would occur today as a sale of the remainder interest, or alternaitvely may be structured as a sale of the home with a division of the proceeds between you based on the life esrtate and remainder value. You need to discuss the issues witha capable trusts and estates attorney. providing them the documents creating the interests referenced. In essence, there is not enough information in your question to provide you a useful answer.

However, defaulting on a provable contractual obligation also creates a right for the agrieved party to sue you, leading to a costly process which can damage your credit and end up costing you more than you could have originally paid to settle the debt. Your "ex" might also be able to sue you for "unjust enrichment." On the other hand, if you do go to court and the Judge decides that there was no contract for you to repay the money or that it was a gift, you would not have to pay it back at all. I do not know enough about your case to suggest which outcome is more likely, so you need to either consult with an attorney and furnish more complete information or decide to take a chance and "let the chips fall where they may," if he really sues you.

I was in the midst of crippling depression and when I got the divorce papers, I didnt get off my sofa for more than 3 weeks, yet I only had 30 days to give my signiture or he said i would get nothing at all. He was a CWO5 in the navy, 32 yrs service, he currently makes 160K a year and he gives me 700 a month ending January 2013. He told me he would give me retirement, but didnt want it in the paperwork, he has not complied with what he agreed to that WAS in the paperwork, and there is a camero that had my name on it, that has been paid off and I have asked him repeatedly about getting my name off the title and he will not respond at all which ;leads me to think he has sold the car illegally or something to that effect. Well, what is the car worth? Its at least 8 years old and possibly older than that if grandmother owned it for awhile. What is the Kelly Blue Book (or similar NADA Guide or Edmunds') resale value of the car? Has an estate been probated for your mother? What other assets does your mother have? What other siblings are there? Did your mother have a husband?

It may be in your best interest to get the answers to these questions and go see a probate attorney who practices in the county where the estate for your mother is or would be probated. Depending on the answers here, it may be that the car can be assigned to you as part of the family allowance. Or in lieu of you paying your mother's funeral bills. If there are no assets after that, then creditors get nothing. Or, if the car value is small then just buy the car from the estate and use the money to pay higher priority claims (like funeral and medical bills and family allowance). If the money is then used up, creditors still get nothing.

However he did write down everything that the other women said (That I went through a stop sign). I had 2 people with me at the time of the accident who also told him the same thing. The officer's opinion is based on information contained in the accident report; therefore, it's not conclusive. Nonetheless, in an intersection accident without impartial witnesses, it comes down to a swearing match. Since she did not have a stop sign, she had the right of way. You can rebut that by saying her car was unlit. It's a difficult case to win since you would have the burden of proof to prove that her car was unlit. Even if you did, you still might be found partially responsible.

As an alternative, a very aggressive or experimenting tenant might challenge the judge's ruling overruling the demurrer by filing for a writ of mandamus. If the tenant's next move is anything other than a timely (and reasonable) answer, I'd recommend retaining an attorney.
