My position at work is being eliminated. I have 10 years with the company and I can retire, but the company will not pay for any health insurance. I'd like to know if I take a "lay-off" and apply for unemployment for the time period it is available (I believe its 40 weeks) when this time period is over, can I apply for my retirement then?

You may want to send your employer and its benefit plans administrators a receipted written request to obtain a copy of the benefits plans under which you are eligible for benefits (including retirement and health insurance benefits) to obtain more information about your rights under those plans. Without reviewing that information, it would be difficult for an attorney to advise you regarding your rights.
