If I moved from one state were the statute of limitation expired after 4 years an then move to another state were it's 10 years can they go back an file in small claims.My last payment was 5/16/2006.



Answer

That's a jurisdictional question. I would think that if you incurred the debt, defaulted, and were unsuccessfully collected on in one state, then that would be the applicable law.

That would be the argument I would make when they sue you, as they undoubtedly will.

You may get some comfort from a recently decided 9th circuit case, and here's a story about it.
