Question

I am being sued for a payday loan that i took in 2005 for $400.00. The lawyers representing the firm is saying they are going to take me to court and garnish my wages. It has been 8 years and i forgot i even took out this loan, in these 8 years i never received nothin in the mail or anything. Today is the first time i am hearing about this and that is because their lawyer called my parents house number and i dont know how they even got that number. Can they really garnish my paycheck?

Answer

The Statute of Limitation has run. This would prevent them from obtaining a judgment. Raise this as a defense in your written answer and file it with the court.
