If a patient has a stroke during open heart surgery that is not recognized until 5 hours after the surgery and dies as a result it the doctor at fault for not recognizing the stroke and acting sooner?
If a patient is given several blood tests and told he has acid reflux when in fact he has stomach cancer, is the doctor at fault when the patient dies of stomach cancer 2 weeks later?
Answer
1. Possibly--- would a diligent doc have noticed the stroke that occurred during surgery?
2. Probably not--- could a quick and correct diagnosis that late in the disease have made any difference?
