I was in an accident with another driver at fault. I retained a lawyer and we have reached a settlement. My insurance company is taking 30% of my settlement. Is that legal?

Since you have an attorney, I suggest that you ask him or her, since the attorney should have the most knowledge about your case.

If YOUR insurance company made payments to you or on your behalf, they are entitled to partial reimbursement under what is known as subrogation. If you haven attorney, he should be able to explain all of this to you. Upon, request, you should be provided with a settlement statement showing who gets what money and for what reason. If your insurance company is being paid money, ask to see the documentation which gives them the right to that payment and how it was calculated.
