Can a person file legal charges against a family for his spouse leaving him with the children after he chocked her and she got a restraining order against him? All the family did was go get her and bring her to safety. He hired an attorney and has threatened her family if she doesn't return to him. He told her he will take her to court and since she is a stay at home mother, he will file for full custody of the children and she will never get to see them.

If the two charges are brought at about the same time, it would not be double jeopardy.
